This just in from Arapahoe County Sheriff Grayson Robinson:

On December 27, 2009, at approximately 1:54 P.M., Arapahoe County Sheriff's Office Deputies responded to the Subway restaurant located at 18525 East Smoky Hill Road, Unit L, on the report of an armed robbery. Witnesses stated that the male suspect left in a purple Toyota Camry driven by a female. Once on scene, deputies made contact with the reporting party and witnesses.

One Subway employee was on duty and working behind the counter. Two customers were in the shop to purchase food when a male subject entered the shop, while his female companion remained in the car. The employee and one customer knew the subjects and identified them as:

Jacob Tyo, 19-yrs-old, and

One Juvenile Female

Tyo entered the restaurant and greeted a male customer that knew him and stood in line while the clerk was helping a second female customer. Tyo then produced a black, semi automatic, handgun and held it to the male customer's side. It took the victim a couple of moments to realize Tyo was serious. He stepped back and when the female customer left, Tyo pointed the gun in the clerks face and told him to give him all the money. The clerk immediately ran to the back room and Tyo jumped the counter and attempted unsuccessfully to break into the cash register. The juvenile female companion came into the shop and yelled at Tyo to leave. They left in a reported purple colored Camry. Deputies quickly obtained possible addresses for both subjects. The juvenile female was contacted, interviewed, and released pending charges. The car was located and identified to be a blue Honda Accord. No gun was found; however, several BBs were found on both the floor of the Subway Restaurant and in the car leading investigators to believe the weapon was a BB gun.

The Aurora Police Department located Tyo at his home. The reporting parties identified Tyo as the suspect. Arapahoe County Sheriff's Office investigators interviewed Tyo, and he was taken into custody and transported to the Arapahoe County Detention Center where he was charged with: Criminal Attempted Aggravated Robbery and Felony Menacing.
