The battle of Brittany Hill wages on

JoeAnn and John Falco took on the stunning Brittany Hill property in Thornton over two years ago, planning to restore the space that was once a landmark restaurant and open an eatery/special events center there. They got to work on upgrades, but the spot never reopened -- and at the end of 2010, the property went back on the market, as the Falcos became embroiled in legal proceedings with SRC Developers, the California-based company that currently owns the still-vacant property.

"We're still battling it out in court," says JoeAnn. "Brittany Hill is on the market but we had a three-year lease with an option to buy out in 2012, so our attorneys are trying to get this settled." SRC locked the couple out of the property despite payments, she adds, stealing tools and materials that they'd left on the grounds.

Court documents note that SRC sent two notices of default to the Falcos before the end of 2009, and then took possession of the property in March 2010 after a favorable judgment. Since then, the Falcos and SRC have been tangled in suits and countersuits. And that, JoeAnn says, leaves the fate of the property up in the air -- and explains why the place hasn't been leased.

But Shawn Sanborn, owner of Sanborn and Company owner and the managing broker for the Brittany Hill property, insists that's not the case. "It is available, we have a listing, there's nothing -- ongoing litigation or anything -- that would prohibit the sale or leasing of the property," he says. He also notes that even a favorable judgment for the Falcos wouldn't change that; the property could still be leased or sold to someone else.

To that end, Sanborn says, there's been a lot of interest in this landmark space -- but the owner is waiting for the right offer before doing the deal.

My Voice Nation Help

Brittany Hill has a special place in my heart. We have celebrated prom, birthdays, graduations and retirement parties there. Every now and then we would have Sunday Brunch. I would love to see it open again, just not by the Falco's. Judging by Joeann's other blogs in regard to Brittany Hill and this article she is being untruthful. Her attempts to threaten and bully other bloggers, says a lot about her character. I would hate to have someone like that running a place that holds such special memories for so many.

I have so many special memories of Brittany Hill (prom, Sunday brunch, graduation, mom's retirement party etc..) I would love to see this place reopen soon, just not by the Falco's. I've read several of Joeann's comments, in regard to Brittany Hill. In my opinion, she seems to be the type of person who would lie, cheat and steal to get what she wants. On several review web pages she threatens legal action to people who leave comments that she doesn't agree with. She will use many different user names saying the exact same thing pretending to be someone else. If you call her on her bluff, she will post the same comment or the sites private policy, over and over again so that no one can see the other reviews. God help anyone who does business with her, I'm sure it will end up in a legal battle of some sort. LOOK FOR JOEANN TO RESPOND TO THIS WITH SOME OTHER USER NAME! FALSE ACCUSATION! AND IN SOME CASES WILL WORN YOU THAT HER HUSBAND IS A COP AND HER BROTHER AN EDITOR FOR THE Westword! If true, who cares! Her attempts to intimidate others are obvious signs of the type of persons she is and the establishment she runs. To hell with the Falco's and best of luck to anyone else wanting to open this beautiful place

Holly, I agree with you. I work at a nearby hospital, myself and my coworkers were all very excited about the reopening of Brittany Hill, until we learned a little more about the would be owners. They don't seem like honest people, it appears that they have other issues in other cities concerning the police dept. We've learned of the issues because they are using the Brittany Hill name to blog about the dept. With that said I would love to see other tenants take on Brittany Hill too.
