You can't keep a good judge down.

Yesterday Joe Nacchio notched a win in the first round of his appeal over his conviction for illegal insider trading, with three appellate judges ruling that the badly toupeed former Qwest exec can stay free on $2 million bond pending an expedited appeal.

But their decision didn't seem to deter U.S. District Judge Edward Nottingham, who last month had ordered Nacchio to start serving his six-year sentence immediately. Nor did the possibility that the appellate court could overturn the entire trial that Nottingham had taken such care to make appeal-proof. Because last night, the judge was out at Elway's, a frequent haunt, looking dapper in a navy suit and product-heavy hair as he cruised through the hundreds of carefully preserved revelers out for the final summer party.

And while we have nothing against strip clubs, our verdict is in: Better that the good judge drown his sorrows at Elway's than at the Diamond Cabaret, where he racked up a $3,000 tab that landed him all over 9News and the dailies this month.-- Patricia Calhoun
