Medical marijuana proposal: Would new city council rule ban caregivers in Denver?

• News for you, anonymous, but the DEA now has information on the over 2,000 people who filled out the state application form, along with their signed federal confession AND power of attorney given to the Department of Revenue AND all of their assets listed in neat columns, ready for civil asset forfeiture AND a list of all your children and their addresses, ready for the state to haul away. They also have a list of hundreds of dispensaries and grows that had operated *before* the state license was required, so don't think you can go back underground. It's a sad situation.

• we couldn't pay kathleen enough for what she is attempting, hopefully successfully, to do. finally someone has the gall to take this head on where so many others with the resources to do so have failed to take action. shame on them. if anonymous is correct then yes, all involved should make sure their respective houses are in order but you would hope and imagine that anyone putting themselves out there like that would have already done so. i for one will be watching closely and hoping nothing but utter and complete success in kicking this horse shit to the proverbial eminefin curb.

• Excuse me. I'm hypervigilant on the subject of the movement attacking itself (so far is it from unifying and moving purposefully to end Prohibition). I mistook you for one of those who hope to make good after the State has driven their competors out of business. Many of us are anxious that the General Assembly's abominations be challenged, provision by provision, on constitutional grounds, in the courts, as soon as possible. I applaud Kathleen for moving to challenge these unconstitutional laws, and I consider it inappropriate to respond with carping. The notion that she is a some sort of DEA operative strikes me as rather daft.

• Anonymous: we aren't going to safeguard patients and caregivers' rights by being bland and nice. Suing is an adversarial process. Perhaps it is a Midwestern sort of problem that so many people in the industry dimly imagine that we can prevail over our political enemies without even raising our voices -- expressing that misperception just trumpets our naivete and ignorance to our opponents. You would rather pick a fight within the movement than deal with the overwhelming forces arrayed against us and don't even have the courage to identify yourself -- screw off! I urge patients to find out where their providers stand -- if the dispensary's owner is not for ending Prohibition, go elsewhere!

• Denver's City Council voted to extort over a million dollars in unnecessary fees from patients in January. A month ago, supposed progressive Doug Linkhart linked the medicinal use of cannabis to law enforcement and youth programs when he proposed extorting another six percent excise tax from patients. Now, Jeanne Robb wants to infringe the constitutional prerogatives of caregivers. The Denver City Council, its appetite whetted by all the money they have stolen from patients, has become obsessed with medical cannabis. Robb seeks to address the problem posed by caregivers growing more than twelve plants inside their homes -- the problem here is clearly that marijuana has driven Jeanne Robb insane. All the measures that Denver has passed or is considering and the City's defiance of Municipal Ordinance 38-176 is approved by the City Attorney, David Broadwell. The entire government of Denver, from the Mayor down, is engaged in an open conspiracy against not only the express will of the People of Denver in repeated elections, but against Municipal Ordinance 38-176 and Article XVIII, Section 14 of Colorado's Constitution. To obsess about medical marijuana and create other mischief we pay each Denver City Councilor $225,000 per year and more office expenses. We need to remove the City's entire political hierarchy from power (and not by electing it to higher office, either). I propose to run an intitiative to slash Councilor's salaries to (only) $125,000. If you buy the argument that Denver needs to offer high salaries to attract talented people, you should be arguing to multiply their salaries on the grounds that the present crew aren't being paid enough. I think we can find smarter people, whose views are more representative of Denver, who will do a far better job than the present Council, and who will do it for $125,000.

• but let's take action NOW!! Not in Nov. NOW NOW NOW. Strike down 1284 and 109.Strike down any other attemp to subvert the State of Colorado Constitution. The Centennial ruling gives ALL dispenses the right to operate..aside f...or the CLEAR language in Amend 20. I know it does nto say dispensaries in the language. Yet it dioes say... d) Notwithstanding the foregoing provisions, no person, including a patient or primary care-giver, shall be entitled to the protection of this section for his or her acquisition, possession, manufacture, production, use, sale, distribution, dispensing, or transportation of marijuana for any use other than medical use. So that covers Dispensaries. One could almost read as a dispenser(person or place) would be not able to be charged because what is going on is for MEDICAL use. Meaning you dont have to be a card holder to sell. Might be a stretch on the second part but non the less Dispenses are covered and Centennial proves it. So why did 2000 apps get turned in to HAND over their rights?

• Just like 1284 and 109 clearly talk about marijuana or medical marijuana...so any attemp to amend (which 1284 & 109 & this new measure intend to do) The Constitution by the legislation is WHOLLY UNCONSTITUTIONAL. A patient may gorw what eve...r is medically needed. SO to limit that is UNCONSTITUTIONAL. TO force a person to grow or not grow in a location is an attemp to redefine what the constitution says. To try and create SPECIFIC zoning laws in regards to medical marijuana...is another attemp to REDEFINE the Constitution of the State. So smashing this measure in a court should be as easy as when Judge Larry Naves struck down the CDPHE on the 5 patient limit and other BS they tried to push through. DISPENSE OWNERS/PATIENTS/CAREGIVERS....WAKE UP! CHALLENGE THESE LAWS!!! FIGHT FOR YOUR RIGHTS. DO NOT HAND THEM OVER TO PEOPLE WHO ARE SWORN TO UPHOLD THE CONSTITUTION. 2010 MIGHT BE THE YEAR WE SCREW SICK PEOPLE BACK TO A POINT THAT IS CLOSE TO PRE-2000. THIS MAKES ME SICK.

• I just wanted to drop another note here for a suggestion to anyone who is as angry and frustrated with the Denver City Council as I am right now. If you are fed up with the priorities of the city government -- who choose hurting MMJ caregivers instead of having the guts to demand the Denver PD release the videotape of the jailhouse murder of a senior citizen homeless preacher by Taser shock and beating, for example -- who overspend and waste time at every opportunity, please research and consider voting for all or some combination of Prop 101 and Amendments 60 & 61 this November. These ballot issues severely restrict the ability of bureaucrats and administrators to recklessly spend our tax dollars to support their warped priorities and petty personal agendas. The DCC just passed a resolution opposing all three of these possibilities; if any of these bills passed it would drastically reduce their legal power over the lives of the citizens of Denver. I've never considered myself a conservative by any means, but the Denver City Council needs corrective measures before it will be willing to reconsider its preconceived notions about its own role and place as "leader" instead of representative body. If you watch the video from tonight's meeting, wait for Carol Boigon's pouty little outburst about the mail she has received on this issue: it is completely obvious by the time she has finished that she will vote on this issue based on her feelings and emotions, not on any type of real science or public debate. This is no real surprise: Rep. Boigon's most intellectual response to the public discussion for Denver's dispensary initiative was to declare that she was suited to regulate our Constitutional rights because she had eaten a cannabis brownie once in the 60's (Really, no lie. I think there may even be an old article about it somewhere here on Westword). Again, I am not a political radical. I am just really sick of these misplaced priorities and stupid ego trips. I'm voting to defund these clowns.

• Douglas County passed an ordinance (3/30/10) that looks surprising similar to Denver Cities proposed one. After Hb10-1284 passed they revisited this ordinance and are still looking into changing it - in what why - I have know idea.
