Medical marijuana grow limits: Denver city council moves them ahead to advocate's chagrin

• To restrict marijuana is like restricting potato's. Except marijuana is safer. If you eat to many raw potato's they contain Glycoalkaloids which may cause headaches, diarrhea, cramps, and in severe cases coma and death. Marijuana does not even come close to this kind of danger. BUT people think they do because every one 40 and older today is a Reefer Madness Baby. Some have seen the light and others are still lock in darkness and do not want the light (the Truth about Cannabis) for they are afraid of the light/Truth. This fear stems from the U.S. Federal Gov't and their Fear & Smear Campaign starting with "Reefer Madness" and adapting itsel to the times. One rarely known or admitted fact is that the smoking or vaporizing of marijuana gives immediate relief from chronic nausea & vomiting. There is no drug in today's pharmacopoeia that controls CHRONIC nausea & vomiting not even the new one Zofran. All anti-emetic drugs are for acute short term use only because their side effects are either lifelong or fatal. Marijuana has no danger like that. Marijuana is more therapeutic to the human body than harmful becaude from the nemaroad to humans we have endocannabinoid systems. Our bodies produce cannabinoid like chemicals called Anandamide and 2 AG. They do everything from control chronic nausea to program pancreatic cancer cells to self destruct. Sounds pretty damn remarkable to me. I know it safely & efficiently controls my chronic nausea & vomiting from Diabetic Neuropathic Gastroparesis (paralyzed stomach.) Yet some people think I should be locked up just for trying to control the severe symptoms of a severe chronic disease. MAKE IT LEGAL, MAKE IT GREEN, IT IS THERAPEUTIC NOT HARMFUL!!!

• Amendment 20 gives me the right to grow 6 plants. As a caregiver for 5 patients (illegal limits - not stated in A20), I grow another 30 plants on their behalf. So 36 plants, half of which can be flowering, is legal. City council cannot override the state constitution. Is city council is willing to waste taxpayer money to defend an obviously unconstitutional limit on plants? I hope not.

• I'm afraid that point still needs to be proven in court. You can be giving the stuff away for free to a single patient and the city will still write that into the code as "conducting a non profit business" or some such. They've shown that they can define it however they want. Did you buy a light so you could be someone's caregiver and give them medicine? Congratulations on starting a business, now talk to your lawyer! Amendment 20 grants an exemption and affirmative defense from criminal prosecution. What it doesn't provide is an exemption from civil penalties and land use laws, not to mention the tax code. This is why your landlord, HOA, or city council can still ban caregiving, until proven otherwise. I hate to be Mr. Negativity in this thread, and Amendment 20 says a lot of things, but it A20 also doesn't say a lot other things that people read into it.

• @ anticompassion: The plant restrictions would apply to personal caregivers, thus skirting around the "business in a home" aspect. The proposed ordinance is completely unconstitutional anyway. HB10-1284 states that cities and municipalities may ban Medical Marijuana Centers; it does not give those cities any right to modify plant limits outlined in Amendment 20. Even if the council approves the measure it will be overturned in court.

• Who'd have thought that Denver, which voted to legalize MJ completely in 2006, would have more restrictive rules on home (medical) grows than Colorado Springs? Someone is out of touch with their public. Don't Denver's home occupation rules already frown on retail sales and limit the amount of a home that can be used for business? Enforce the code you already have!
