Medical marijuana lawsuit: Jessica Corry on why dispensary ban shouldn't be on El Paso ballot

• For those of you questioning these lawyers, you should get your facts straight. There are now no less than seven lawsuits across the state challenging different parts of 1284. It's a 100 page bill and it's more complex than some single lawsuit. These lawyers, including mine, have lobbied successfully to get positive changes without resorting to suing the state. Remember that residency ban? Yes, well now it doesn't apply to employees. These are complicated times and attacking the only people out there fighting on behalf our community is a slap in the face to all of their hard work. And to the person questioning the 150,000 registered patient estimate, that comes directly from the state health department, as told to The Denver Post several weeks ago.

• PCRLP has a lawsuit being prepared on behalf of the patients and the caregivers as they are the only ones with constitutional protection. to donate go to cannabislawsuit.com MMC's are not protected by the Colorado Constitution and MMC's are nothing without patients. Maybe when the DOR requires the intrusive fingerprinting and video surveillance and MMC's lose their clientele they will reconsider.

• PS, state lawmaker Chris Romer wants to be the next mayor of Denver. He hasn't announced this yet, but if Hickenlooper wins the governor's race, Romer will make an announcement. Please do not vote for Chris Romer as mayor or re-elect him to any position of power. He personally created laws that shut down over 200 legitimate dispensaries and eliminated over 500 good paying jobs for nothing more than politics. As a state legislator at the capitol Romer spends more time talking to reporters and wealthy business owners & lobbyists than he does answering phone calls and emails from his constituents. Romer is a power hungry, selfish, fool who cares only only about his belief that his destiny is to be Colorado's governor one day. Let's stop this guy in his tracks. • it's true that all these lawyers have been quoted that they would fight 1284 all the way to the state supreme court. Of course, at some point rhetoric ran into reality and these lawyers need to earn a living just like you and me. I am disappointed that all the sabre rattling from these lawyers has been hollow but, really it's up to us to fully decriminalize / legalize marijuana and "Take Back Our State" from these crooked politicians, greedy lawyers, and utterly insane police and law enforcement types. The movement is afoot, keep your eyes and ears open for full legalization ballot amendments. And the way things are going, I'm all for legalizing marijuana in the same way tomatoes are legalized and bypass the whole taxation and regulation thing. The state of Colorado and it's moronic lawmakers and law enforcement should not derive tax income from this plant if they continue to persecute it's existence. Be warned Colorado lawmakers and law enforcement, if you keep up your anti-plant shenanigans you'll end up with nothing to show for it! (there are numerous legalization ballot initiatives being drafted as I write this!)

• I agree with Billy, all these lawyers talked a great game as they were taking their $10,000.00 retainers, and offering meaningless paperwork back in 2008 2009. But now that the cards have been dealt they have folded on the patients and the small owners. But mostly on the folks that got you your first taste of cannabis and paid the price as far as felonies & prison time. • Politicians' tendency to incur public liability serves as an indirect measure of the intelligence of the polity. Colorado's politicians are positively champing at the bit to commit illegal acts (such as the arbitrary taking of businesses without compensation) for which their constituents will have to pay. Colorado can't be too bright, judging from the antics of its pols. We are the land of plenty for lawyers who want to make an easy buck suing the State. The real reason the dispensary ban should not be on any local ballot is that HB1284 is blatantly unconstitutional. Caregivers have the right to dispense cannabis to patients under Article XVIII, Section 14. The places where dispensing takes place are (perforce) dispensaries, and whatever regulation of dispensaries is legal, an outright ban clearly is illegal. I hope Jessica advances this argument as well; overturning the affront to the Constitution which is HB1284 is far more important than beggaring Castle Rock for pointlessly destroying a thriving local business -- may she accomplish both!

State law mandates a $100 fine for possession of marijuana under an ounce. Cops stopped wasting their time and resources on nearly all marijuana investigations 2 years ago. Smoking pot does not kill anyone, it does not lead to dangerous crime, nor do dispensaries attract violent crime in the areas they are open for business.
