Brad Mitchell, Scarlet Ranch bartender, latest to allege excessive force by Denver Police officers

There are no shortage of excessive-force complaints against Denver Police officers these days, as our reporting about cases involving Michael DeHerrera, Alex Landau, Nick Lynch and others demonstrates. The latest? A threatened lawsuit by Scarlet Ranch bartender Brad Mitchell, who claims cops slammed him to the ground without provocation, and supports his assertions with video.

The story comes to us from CBS4's Brian Maass, who obtained surveillance video of a raid on the Scarlet Ranch, a swingers club, last May. In the clip, on view below, Mitchell can be seen being pulled to his feet from a sitting position on the floor, then put into a chokehold and taken down. Mitchell insists he did nothing to instigate this response. Denver Police counter that Mitchell attempted to pull away and was resistant -- and an ex-Denver cop questioned by Maass agrees with the DPD position, although he concedes that footage of the incident "looks bad."

Westword readers will be familiar with the Scarlet Ranch from our 2006 feature "Swap Talk," which detailed a swinging feud between Scarlet Ranch owner Kendall Seifert and Scottie Ewing, onetime owner of a club dubbed Sindicate. Last September, Ewing pleaded guilty to tax evasion in relation to Denver Players/Sugar -- operations run through Sindicate Media that prosecutors described as prostitution businesses.

Seifert's style is very different from Ewing's. Last September, he sent out an e-mail seeking investors for Scarlet Ranch, which he said was entering a new era. And instead of hiding from CBS4's cameras, he takes the spotlight, defending Mitchell in the clip below.

Even if Mitchell moves forward with his suit, there's no guarantee he'll succeed in court. Lynch's initial complaint was rebuffed, although his attorney promises that the fight will go on, and Denver cop and ex-American Gladiators contestant Vicki Ferrari recently won the day in an excessive-force beef lodged by a manager at a Grease Monkey.

Still, the accretion of accusations can't please members of the Denver Police Department. Here's CBS4's report:

Daryl Orr and Theresa Orr, the swingers that lied in the news story for the station they work for; Fox, channel 31 are still working. Selling their drugs and as corrupt as always.

Really? Just to set the record straight....Scarlet Ranch got a small check for $42,500 from the City of Denver for this issue.

 

Just the start of the war.  Next time, maybe the city should get a warrant!

Looks like Denver has the last word since Scarlet Ranch was shut down. I guess they had enough of this shit hole. The guy that owns this place sounds clueless and names everyone for his own fuck-ups.

Mr. Mitchell looks like a typical hippy idiot who cant follow directions. Looks good to me. It's really not that hard to put your hands behind your back after all...dumb.

What the news story did not cover was that the cops kicked everybody out of the club and then sat at the bar watching porn for almost an hour. A great use of your tax dollars! Yep, we have that on video as well. Is that procedure DPD?

The cops tried to write their reports to cover their asses, but we will have to see what the jury thinks about their actions. The news story showed very little, but we have multiple cameras showing the entire incident.

They lied in their reports as they had no reason to attack our staff.

We maintain video security to protect us from the bad guys, just did not think the bad guys are the Denver Police Department. What a disgrace.

The raid was a result of a news story by Fox News in May, 2010

Heidi Hemmat produced a story she knew was false stating our staff was giving away ecstasy, proven by an “undercover” person who had come in to the club.

The problem is the “undercover couple” was Daryl & Theresa Orr, employees of Fox News that were actually members of Scarlet Ranch earlier in the year and they were kicked out for offering ecstasy to other members.

Daryl or Therese Orr had not been in the club for several months and then lied on a police report stating they had just been in that night and provided ecstasy to the police he stated came from an employee.

This false report prompted Denver Police to raid our club (without a warrant) and tear it apart looking for drugs. None were found, but they gave us several tickets for what they said were liqueur violations. The judge dismissed them all.

I know the boys in blue protect their own, but really, they are stretching things a bit to far here with their excuses/explanations. The only sudden movement he made was in response to his arm being wrenched. Not an attempt to escape, an effort to reduce pain. If DPD thought they had a case you can bet you but they would have showed up for his court dates.

                                       It comes to my attention that you continue to make frivolous  accusations and slander along with defamation of character with out evidence which you claim to have in your attorney's possession. Following facts. Your video cameras violate privacy of your own members according to your posted policies dated 2009 throughout your establishment which is now located in Arapahoe County. The former Mrs. Orr is not and has never been an employee of FOX news in Denver nor was she ever involved with LocalTvLLC or its news operations. 2 You have failed to provide evidence that your claim of the "2 fox news employees" did or ever supply or distribute any type or form of Illegal drugs in your establishment. 3 keeping a record of Colorado drivers license on file by making a copy is Illegal. 4 by disclosing of members of your establishment after they sign and adhere to your agreement makes you liable for disclosing the privacy and opens you to legal actions. 5 It can be proven that all statements in this Westword blog was written by an electronic device owned or maintained by yourself with a simple document from the court to establish IP identity number. 6 Claiming to be a non profit organization can be investigated by legal experts known as the IRS as your former partner Scott Ewing was subject to.7 there was a Denver Sheriff's deputy with the individuals you question at all times and is more than willing to testify to your allegations. 

We demand that all blogs, topics, statements, accusations and derogatory mentions of the two individuals you accuse cease and desist.  Note, Date of last post October 1, 2013.

This is a public forum/blog this will serve as public notice of our request for you to adhere to our demands. Final summons and notice will follow through process server if and when any further action is needed through the Arapahoe County Civil Courts Clerk.

Scarlet Ranch moved to a new, larger facility. Get your facts straight. Oh.....and yes, Scarlet Ranch did file a suit against the city and it is in the courts now.

Show the video of the 2 "fox news" reporters dealing drugs in your club. In fact pull video from your outside cameras. Show the video of you throwing them out ? OH wait, all you have is your bar tender/dealer being harrassed by cops. I may offer them representation.

Wow! You have videos in your club?! A swingers club where anonymity is the name of the game? Honestly, this video is lame. The guy is clearly not going with the program and the cop drops him on his ass. Yeah it looks bad, so what? If the guy follows directions it probably doesn't happen right? Hey I'm no cop lover, they are all pretty much assholes, but I just don't see the problem with this one. Btw, I won't be coming to your club to swing, I don't need my face all over tv for my family and co-workers to see!

Hey Kendall,

You should get your facts straight before someone sues you for Slander and Defamation of character. Putting false accusations out like that will end up making you look stupid and losing alot. I'd reconsider your statements before posting them. I happen to know those 2 personally and KNOW FOR A FACT it was someone from your competion that took a phone camera in for the news. Good luck moving to your new location pal.

Daryl Orr and Theresa Orr lied on camera. This was many years ago, but still true. They made up a story and it led down a path where the City of Denver had to pay Scarlet Ranch in a lawsuit.

The guy is sitting in a chair where the cops put him when he his grabbed by the cops and thrown to the floor. How is that not following directions? Whose face are you seeing? They are all cops.

And the club is private, so they would probably not take you anyway.

We received all information from our lawyers discovery. Yep, those are copies of the false reports they filed.

Daryl Orr and Theresa Orr were members of Scarlet Ranch and ScarletLifestyle.com. They were swingers and kicked out of our club for drug use.

Daryl Orr filed a false police report. Fox News removed their story from their website after learning of these issues.

Scarlet Ranch opened in 2003 and we work very hard to protect our members against people like Daryl and Theresa Orr.

If they would like to meet in court, we are more then willing :)
