Developer Mickey Zeppelin responds to charges that he revealed locations of growhouses

Developer Mickey Zeppelin says he isn't a public official and did not violate any law by discussing the location of a grow facility in the River North neighborhood, where he's a major property owner.

Last Thursday Dan Emmans, owner of Grass Roots Health and Wellness Center, filed notice of his intent to sue Zeppelin, current councilwoman Judy Montero and former councilwoman/now Zeppelin consultant Susan Barnes-Gelt for disclosing the location of his grow. A draft of the lawsuit charges that Zeppelin repeatedly made the grow's location public, both during news interviews as well as when he was discussing the property during Denver City Council committee meetings.

"There isn't any real substance to the lawsuit," Zeppelin says. "His basic complaint is based on the fact that the locations are supposed to be not disclosed. But ... that is only with regard to public officials."

Under state law, the locations of grows are exempt from the Colorado Open Records Act; "state and local licensing authorities shall keep the location of an optional premises cultivation operation confidential and shall redact the location from all public records."

Zeppelin denies Emmans's allegations that he continually contacted Emmans's landlord and harassed Emmans. He also denies that he and Montero have a financial relationship, noting that while he developed the property, he does not own the TAXI building where Montero has her city council office space.

Zeppelin, who is not shy about noting his opposition to growhouses in the area, says that that growers took advantage of a loophole in the old zoning code and did so knowing they didn't have the right permits to remain open under the zoning code adopted last year. On Tuesday night, councilmembers will decide whether to grandfather in growhouses established in areas that were originally zoned for commercial use but are now prohibited under the city's new code.

The threatened lawsuit, Zeppelin says, is nothing more than a political move by growers angry over Denver's proposed ordinance changes. "I am a lawyer, and looking through it, there is no breach of contract, there is no anything," he adds. "It is someone who is having some financial problems and is trying to find a scapegoat."

That section of the law only applies to officials in charge of public records. It's not a gag order on private citizens. Legally, Zeppelin has the right to say and do whatever the hell he wants as far as the location of a grow house.

This is a repost from an earlier article but I felt given Zeppelin's obvious attempts to manipulate the local zoning laws and Montero's complicit participation it was important to repost:

The City Councils constant tinkering in the economic development of the city interferes with traditional market forces at work in a healthy normalized economy.

In a healthy economy users of resources must bid for use of a scarce resource, in this case the land. If Zeppelin Development felt that the land was more valuable being used for development than Emmans and other building owners they would increase their bid to the point where it made fiscal sense for Emmans and other property owners in the area to sell their rights to the property.

Due to Montero's tinkering and interference normalized economics are not being allowed to function and Zeppelin is manipulating the market price of this land by abusing zoning to reduce the value of the land by preventing other users to bid what they consider a fair value for use of the land.

The end result of this is that Zeppelin Development gets their land at below market price instead of having to pay "what the market will bear", as occurs in a functioning economy. They are able to obtain the property at a depressed price due to the inability of others to utilize the space for their desired purpose.

Thanks City Council for ass F*CKING common sense economics, robbing building owners of their properties inherent worth and allowing developers to manipulate the city zoning laws to allow them to obtain property at below market pricing. Good Job, keep it up, maybe we can sell the City and County building to them for a discount if we change the zoning laws there. Lord knows I would love to have a condo in the converted City and County building.

hubris, thy name is Mickey Zeppelin and Judy Montero and your asses are about to get handed to you both in a court of law. I can't imagine the negative publicity helping those two people out...You can smell the conflict of interest between those two, can't you?

Note to Councilwoman Montero: you would be wise to follow Hickenlooper's example and make your real estate fortune BEFORE becoming an elected official who represents us Denver citizens. You have betrayed our trust with your backroom deals to help you and your real estate developer cronies get rich while regular citizen's good paying jobs are legislated away. To top it off, I bet there are now upwards of a dozen investigative reporters from television and the newspapers digging into your background...your career is likely over and you brought this all on yourself. Do us a favor and just resign already.

I am not sure what miserable delusional place you come from but I and everyone I know familiar with City Spirit loved that place and remember it fondly. Mickey and Susan gave Denver a real gift with that gem of a gathering place. We all miss it and we are grateful to them for those memories.
