Medical marijuana attorney Lauren Davis tells why lawyer group hasn't sued to stop HB 1284

Last week, medical marijuana advocate Kathleen Chippi, who's collecting funds for a lawsuit to stop HB 1284, Colorado's main MMJ regulatory measure, criticized attorneys who'd announced their intention to sue over the bill last year but haven't done so. Why not? Lauren Davis, a lawyer in the group, offers a variety of reasons, most pertaining to divergent opinions among members.

"There were disagreements in legal analysis and legal strategy," Davis says.

There's no hint of such a schism in a May 17, 2010 press release entitled "Attorneys Announce Plan to Sue if House Bill 1284 is Approved." The document, on view in its entirety below, declares that a cadre of attorneys, including Bob Hoban, Jessica Corry, Brian Vicente, Rob Corry, Sean McAllister and Davis "will head to court should lawmakers grant final approval to a measure seeking to unconstitutionally restrict patient and caregiver rights."

But once Governor Bill Ritter signed HB 1284 into law, Davis notes, a variety of views emerged about what to do next "in terms of when would be the right time to file a lawsuit -- whether we should wait for someone to be prosecuted under the caregiver provision and challenge it as part of the defense of that suit, or whether we could bring an injunction prospectively to prevent those provisions from taking effect. There was a question of whether we would have standing, and whether we could meet the burden of a court finding irreparable harm without a prosecution having been undertaken. And because of those differences, there was never a meeting of the minds as to what the right approach would be to challenge 1284."

In addition, Davis continues, "there was a school of thought that we should sit back and wait for the legislature to correct some of the provisions that lobbyists were telling us would be changed in the next legislative session. A lot of people adopted a wait-and-see attitude, thinking that we wouldn't lose the ability to challenge down the road. And if the legislature fixed what their staff conceded off the record to lobbyists and other advocates -- that the staff knew some sections were unconstitutional -- it would be better to let them do it rather than filing a lawsuit to force them."

So... did HB 1043, the so-called MMJ clean-up bill, take care of these problems?

"Not even close," Davis acknowledges. Among the issues she mentions are the ability of municipalities to ban MMJ retail sale, the lifetime prohibition against individuals with past felony convictions from participating in the industry, and the rule requiring dispensaries to grow at least 70 percent of their product while obtaining no more than 30 percent from other sources, aka the 70-30 rule. "That's completely arbitrary," she believes.

Moreover, she goes on, "I think the caregiver provision got even worse. The constitution doesn't require a primary caregiver of a patient to register with the state. So a provision that requires the primary caregiver to register the location of the cultivation operation is highly problematic -- because you've essentially modified the constitution through a statutory requirement that should be outside the ability of the legislature."

Onetime group member Rob Corry agrees. In a post published yesterday, Corry said he would encourage Governor John Hickenlooper to veto HB 1043 in part because of this change for caregivers.

Is a suit against HB 1284 still possible?

"I don't think the window has closed," Davis allows, "but we've lost momentum, lost steam. The reason the primary caregiver provisions were so important was that, pre-1284, everybody was operating as a primary caregiver. But now, primary caregivers and center owners, employees and providers are two different routes to provide medicine, with two very separate sets of rules -- and most people are operating under the regulatory structure."

As such, entrepreneurs most financially able to fund a suit no longer have as great an incentive to do so. The result is what Davis calls "the freeloader effect. Everybody wants something for nothing. They want someone else to bear the brunt of the costs, and unfortunately, that's just not how lawsuits work in our society. They're extremely expensive, and it boggles my mind why people think attorneys who are already doing lots of pro bono work and dedicating lots of free time to educating patients, holding forums and essentially giving people free legal advice should be responsible for all the cost."

For this reason, Davis believes 1284 will likely be challenged in piecemeal fashion. Take the rule that prevents one caregiver from helping another during vacations, illnesses and the like. She predicts that "somebody will get prosecuted for assisting someone in providing medical marijuana to a patient, and they'll be charged under a complicity or conspiracy theory based on 1284. Then we would be able to challenge the legislature's ability to limit the authority of the primary caregiver to have others assist them."

But unless Chippi is able to raise the $25,000 to $50,000 needed to sue, Davis doubts that a full frontal assault on HB 1284 will be undertaken in the near future.

Some one or group is getting desperate about this lawsuit: to resort to anonymous accusation of neo-naziism and racism against CTI is the lowest and cheapest sort of ad hominem. It's the type of sucker punch created by law enforcement, who hide behind the anonymous nature of the internet to create dischord and chaos amongst protest groups. It's a time honored scam that dates back at least to the Nixon admin and Operation Cointelpro.

My guess is that if we were to run IP traces on the "Anon" and "Guest" posters making such terrible accusations against CTI we would quickly find a route back to Jerry Peters or some other assclown on one of the Metro Drug Task Forces....or an MMC owner who wants to kill the open market and patient's rights and sees CTI as a barrier to market domination.

Let me be clear on this: I don't give a rat's ass if a few members of CTI used to believe that the Earth is hollow and ruled by George Soros the Lizard King of Lithuania and had a swastika somewhere on their website (context, anyone?): I really don't give a fuck. This belief is no more ludicrous to me than the one held by millions of Americans that they are ruled by an Invisible Sky Wizard who despises homosexuals and women who have abortions.  Sure, the idea is bullshit....so is most of human understanding. Get over it.

I care about the people most willing to fight the corporate-state takeover and abuse of patient's rights in CO. Kathleen Chippi has always been one of our strongest and most effective voices and I wish her well with this ongoing attempt to make our "elected representatives" and "law enforcement" community follow the goddamn Constitution. She's a hero for Colorado patients and I distrust and disrespect anyone who fails to acknowledge her incredible level of dedication to freedom.

It really upsets me when I hear "everybody wants something for nothing," when it comes to the pot industry.  I wanted to start a gourmet edibles biz with my son but how can a person on disability ever get $5000 to get a license?  Some of the afore-mentioned lawyers helped craft these rules to sell out the little people and kill entrepeneurship in CO.  Some of the monies to fund some dispensaries came from CA big pot biz.  I make less than $10k/yr. and it is not easy to pay for my meds.  (I could get percocet for very cheap on medicare, but it really makes me ill.) (I have lupus).  Living in low-income housing wouldn't allow me to grow even one put plant.I also have celiac disease, and the lupus is efecting my lungs now, so I really should be making my own edibles, but I certainly can't afford to buy enough pot retail to bake in the quantities I need, and tinctures are also very expensive retail.  I don't want  "something for nothing," but I sure miss the '70's when I had my garden in my back yard...

SailorJerry423, you can get your money back by placing RFID chips on all your money getting a special license from the department of revenue in hopes that they will grant and authorization for you to legally operate to get your money back.  But the government needs to know all the pertinent identifying information for you and your employes or friends we don't care and they will have to be fingerprinted and have photos taken by the MMED, which is a law enforcement division, not because they want to arrest you for getting your money back they just want to track all money transactions.  Oh and if your happen to be a caregiver they are coming for you too because the MMED knows now that the dispensaries are all but out of the way it's the caregivers that are the real people trying to get money back and MMED will have plans to track them too because they have your money and you can shut up and take it like a good sailor and just remember this is it legitimize the money getting back industry.

Why would Corry or Lauren want to file any lawsuits? They're making tons of money representing dispensaries protected by 1284, just look at the hate coming from all the anonymous posters in here anytime someone mentions overturning 1284, dispensary owners could care less about patients and they would love to see all caregivers in jail.

Except I did not freeload, Lauren.  As a matter of fact, one attorney in this group still owes me $5,000 returned for NO FILING in a year, including dozens of unreturned phone calls and emails and many promises of "I'll have a final draft to you in 2 days.  The whole reason I had to hirer another attorney was because Come Sept 2010, I still had NOTHING from the promised group.

Why is Laura Kriho the owner of a website that links to anti-semetic new world order conspiracy theories?In a recent CTI press release, she linked several times to her website, http://www.levellers.org.The page features a swastika image that links to Bilderberg.org, a conspiracy theory website. Googling "Bilderberg jews" reveals the type of hate groups who are interested in the Bilderberg Group.She also makes a point of bringing up Soros and Zimmerman in her press release, both of whom are Jewish.Denounce Laura Kriho and her racist conspiracy theories. Don't let her hide behind the "out of state interests" veil any longer. This type of hate has no place in the year 2011, and certainly not in the medical cannabis industry.

Lawsuit WILL be filed within the next month as our deadline is July 1, the day hb1284 is implemented.  We need to get an injunction while the status quo – literally "the state in which"  is still A20.  On July 1, hb1284 gets implemented and then the status quo is hb1284.  So there is an END date and it's a coming down the track.

The only question at hand is who (attorney-wise) will be filing it?

If I can raise $30,000 in the next 10 days, we have the BEST chance with Andrew Reid filing on our behalf.  Andrew is the best attorney for this job.  His firm just set precedent 2 weeks ago when they won one for the doctors.  Andrew handled the constitutional arguments.

It sure is hard to find anything negative to post about Laura Kriho that reflects poorly on her.  Apparently she has a long history as an activist fighting for freedom and truth.  I had no idea that when I searched the web I would find thousands of listings and links, and as far as I can tell they are all her.  Kudos, Laura!
