Kurt Riggin: Complaints in Park County medical marijuana case dismissed after long legal fight

"It's finally over," says Kurt Riggin about his twisted legal odyssey. He'd originally been accused of attempting to influence a public servant and criminal impersonation in Park County stemming from advocacy on behalf of a medical marijuana patient who claimed law enforcement was harassing him. But the case was dropped yesterday, a month after the Colorado Supreme Court rejected contempt charges against him.

As we've noted, Riggin is a member of the Federal Bar Association who represents several Native American tribes in a legal capacity. However, Colorado hasn't licensed him to practice law here -- and in 2008, the Supreme Court accepted a judge's recommendation that he be barred from serving as an attorney in the state.

The following October, Riggin and medical marijuana advocate Timothy Tipton headed to Park County, where the aforementioned patient, a Tipton pal, said reps of the local sheriff's office were hassling him because he dared treat his pancreatic cancer with medical marijuana. Riggin responded by filing what he calls "an informal administrative complaint" against a Park County deputy. When asked if he was an attorney, he answered in the affirmative and mentioned his Federal Bar Association membership -- but he stressed that he "wasn't there to represent anyone." Nonetheless, he was subsequently arrested for allegedly misrepresenting himself as a lawyer licensed to practice law in Colorado.

A solid year later, the Supreme Court ruled in favor of Riggin, based largely on a recording of the conversation in question. It supported Riggin's contention that he said he wasn't representing the patient.

This decision cut the legs from underneath the initial Park County complaints. And yesterday, the case was finally put out of its misery, much to Riggin's relief. After all, as he notes, "It's been well over a year" since the ordeal began -- so long that he can't even remember when it all started. "I think I was arrested last March or April, somewhere around there," he says.

Oh, yeah: The deputy the patient said had been harassing him is no longer employed by Park County, and the corporal who interviewed Riggin has been demoted.

Too bad this was not a big joke although it should have been I guess if you arrest everyone who files a complaint against a thug cop,that will stop the rest of the citizens who think they have rights your tax dollars at work.

Park County unelected Judge Stephen Groome and other officials committed Federal felonies under the Civil Rights Act of 1964 when they knowingly and falsely charged Kurt for exercising his constitutional right to seek redress of grievances -- for asking the direct supervisor of a deputy engaged in a campaign of illegal harassment to investigate that conduct.  I suggest that the real story here is that there is no interest in pursuing outrageous and felonious official misconduct happening just two counties dowm US 285 from Denver.  Colorado, roll over and go back to sleep.

P.S.  Michael, how about eliciting a response from Mr. Walsh -- is anyone investigating how two felony charges could be lodged against Mr. Riggin for asking that then-Deputy Hannigan stop beaming his spotlight into a PTSD patient's trailer late at night?  I at least would like to know.

Profound THANKS to Kurt Riggin for stunning the courts with his courage and commitment to OUR rights and freedoms -- I hope all of you remember this 4th of July the great sacrifices this man took to fight for ALL of our similar needs/rights/humanity FOR MORE THAN A WHOLE YEAR! This is a profound example of what ALL of us need to support! We must tell the "disrespectful thugs" NO MORE CORRUPTION, etc. and we need to support those who take the bull by the horns and "compel" the courts to STOP THEIR CORRUPTION AND START PROTECTING AND SERVING OUR LIVES, OUR SAFETY AND OUR HEALTH. They cannot silence all of us...civic responsibility rocks! Spread these posts about Kurt would be a good start, esp. for those living in Colorado and those who are of native American descent. I know 1st hand how the Park county sheriffs department treats the disabled who use medical marijuana. They searched my house and confiscated my plant (1) and all my paraphernalia, But it never went to court, no charges where brought up against me, and my items were never returned. So apparently they can come in your house and take whatever they want with or without warrants or charges. so it's good to see that they don't always get to do as they like.Congrats Kurt

Years wasted on something that should have never gone to court...it's mind boggling. Judges, prosecutors, and other public employees in the judicial system: don't you have something better to do with your time and our money? The courts are overbooked because of time wasted on matters that should be settled in a matter of hours...possibly days....not YEARS.

In a resent study, Mortality Within the First 2 Years in Infants Exposed to Cocaine, Opiate, or Cannabinoid During Gestation - pediatrics.aappublications.org A total of 2,964 infants were drug-tested at birth to see if they were positive for drugs - cocaine, opiates and cannabis were studied and compared to drug free infants. During the first two years of their lives, 44 babies from the original group died. The death rates were :

"No drugs at birth" deaths……..15.7 deaths per 1000 live births

"Cocaine positive" deaths………17.7 deaths per 1000 live births

"Opiate positive" deaths……….18.4 deaths per 1000 live births

"Cannabis positive" deaths…….. 8.9 deaths per 1000 live births

The "cannabis positive" infants rate of death is almost half of what the "No drugs" infants death rate is! When it comes to failure to thrive, cannabis shows a significant improvement in the outcome.

If the body is low on cannabinoids, just as with any other deficiency, the body does not function correctly since the endocannabinoid system regulates all other systems in the body. Misinformation has done much damage over the last 73 years as has the war on a plant and those who use it. Cannabis has continually been shown to be a remarkable anti-inflammatory which could be of great help to the 86 million people that suffer chronic pain. No one ever died from cannabis/marijuana though much suffering has taken place from the prohibition of it. It is time to end this travesty.

It is ashamed that the Park County Sheriff's Department apparently hasn't learned their lesson from this incident.

The hospice patient reports there has recently been a resurgence of police intimidation tactics utilizing neighborhood civilians in an effort to "Run this MMJ Patient" out of the area.

Although Kurt Riggin's Health and attitude prevent him from further advocacy in the Bailey/Harris Park area, there are always hopes that someone new will STEP UP and say enough! Let the 'End Stage of Life' patients alone, believe me, they suffer enough.

Apparently, some of those in Law Enforcement think this is funny?

I implore Sheriff Fred Wagner to regain control of his force and allow compssion and professionalism to prevail.
