Medical marijuana: Is cancer patient Bob Crouse being prosecuted over paperwork snafu?

Bob Crouse is a longtime Colorado Springs restaurateur -- the eatery Yakibob's is a local staple -- as well as a cancer patient who uses medical marijuana. But he could also become a convicted felon. He currently faces criminal charges related to cultivation and distribution for exceeding the state's plant limit, even though his doctor recommended a higher count -- one the state didn't approve because of what he describes as a minor technical error on a form.

Crouse, 63, has lymphocytic leukemia that's currently in the chronic, rather than acute, stage -- a period during which oncologists typically monitor the disease, as opposed to bombarding it with radiation and chemicals. But that doesn't mean he's symptom-free. He says the condition -- which was discovered four years ago via a blood test administered after he fell from a ladder, breaking several ribs and puncturing a lung in the process -- causes varying degrees of pain throughout his body, but especially in his neck and shoulder area. In addition, he suffers from stress, anxiety and sleep disorders.

Medical marijuana provided him with the most consistent and effective relief of any therapy he tried; he's a registered patient. But as he conducted additional research into the plant, he discovered Phoenix Tears, a cannabis oil treatment associated with Rick Simpson that fellow cancer patient Larry Shurtleff credits with eradicating a tumor that caused him to lose an eye and all his teeth. This week, Shurtleff underwent successful facial reconstruction surgery after being diagnosed cancer-free.

In order to make his own Phoenix Tears, Crouse needed more plants than the six okayed per patient by Amendment 20, the measure that legalized medical marijuana in Colorado. However, this number can be exceeded if a doctor believes more marijuana is medically necessary for a particular patient. And in Crouse's case, his physician gave him a written recommendation to obtain 75 plants, which he says would "grow enough weight to be able to manufacture the tincture."

After getting the doctor's approval, Crouse filled out the application and submitted it to Colorado regulators, after which he began to acquire more plants. But three months later, he notes, "I got the application back from the state saying there was an address on one piece of paper that was different from the address on another piece of paper. So they needed to have it done again and submitted back as soon as possible."

But before that could happen, on May 1, local police knocked on his door. "They told me they were there to check on my plant count," Crouse recalls. "They began to explain that they had people coming over with search warrants. And over the next three or four hours, ten or twelve different government-task-force employees arrived in eight or nine brand new SUVs -- and they dismantled and took everything I had."

In the process, "they treated me like a criminal," he allows. "I thought due process was something we did in this country, but they came in and basically convicted me. They took my meds, and they haven't allowed me access to them since -- and it's hurting me. I can feel in my own body what's going on, and slowly but surely, I continue to go downhill."

According to 4th Judicial District DA's office community outreach director Lee Richards, Crouse has been charged with marijuana cultivation/thirty or more plants and marijuana possession with intent. Since then, he's been offered a deal, but he finds its particulars to be wholly unacceptable. "They told me I can plead guilty and be a felon and not have access to this medicine anymore -- or else I can go to jail and not have access to this medicine anymore."

At this point, Crouse is being represented by a public defender, but he's got someone else in his corner: activist and blogger Mark Slaugh, who first told his story earlier this month. In Slaugh's view, the key to Crouse's defense is the case of Jason Lauve, a patient who used medical marijuana to address pain caused by a broken back. He, too, was arrested for having too much pot, but in 2009, who was acquitted by a jury under the theory that language in Amendment 20 regarding the amount of marijuana deemed medically necessary was too vague.

"Lauve had a verbal recommendation from his physician for more plants -- and Bob has a written one," Slaugh points out. "And in Jason's case, the decision was, as long as you have a recommendation from your doctor, you're okay. So Bob has an affirmative defense for medical necessity due to his cancer and the type of medicine he was making. But the district attorney sees it as a criminal case."

The next court appearance for Crouse is on August 18 before Judge Tim Schutz in El Paso County Court, and he plans to keep up the fight. In the meantime, he says, "I just want people to understand what I'm doing. In my opinion, I'm just trying to save my life -- to make the quality of my life one I can manage without developing side effects from other types of western medicine. Medical marijuana helps: It's necessary for a lot of people."

If Crouse lived in Boulder, or even Denver, he would not be the victim of a witch hunt. Unfortunately, Colorado Springs, due partly to its conservative military culture, is not a place that's tolerant of MMJ.

OMG!  I just heard Bob on the Thom Hartmann show.  The cops came in and demanded copies of his mom's prescriptions.  They took all his mother's medications!  (thyroid meds and the like.)   What if she died because she didn't have her medications?

Who keeps a copy of their prescription?  Mine are at the pharmacy.

I was sent an email not labeled confidential by a paralegal from Robert Corry's law office. Though their client was not identified, they are looking for people to testify next week in the Springs about plant counts and tinctures etc.

If the DA is going to charge Bob then Colorado's Medical Marijuana program is a failure. If Bob cant use his Cannabis in whatever form and in any amount he requires to address his cancer then what use is this program ? If the law is so eager to make an example of an extremly sick man then what makes us think it will not be our turn next.This is why i dont support more regulation to be scrutinized by.End human suffering and vote for total decriminalization!

Brian you are dead on the money !As long as we continue to provide law enforcement with Cannabis regulation in the name of "legalization" Cannabis users will continue to go to jail. Until every single law pertaining to Cannabis is abolished the man will still be in your sack of weed. If people think that voting for current initiatives will loosen the laws strangle hold them these same people are truly high on their own supply. By voting for more regulatory Cannabis laws we only provide the means for law enforcement to scrutinize users and determine their legal violations thus producing revanue for the state as well as for the attorney it will take to process violators through the system. I do not support more Cannabis laws in the name of legalization. I only support complete de-criminalization in the name of legalization. I will be voting for complete de-criminalization not re-regulation of Cannabis at the poles. Colorado has already produced an entire law enforcement division just to police Cannabis and i hardly think we need to continue to empower them by requesting more of their "throw you in jail service".

It doesn't matter how legal you make it -- the state will still treat you like a criminal if you make even a minor mistake. Stop pretending that this can be "reformed".  The only solution is to completely decriminalize marijuana, and all other drugs.

I guess some people are so ignorant they have catagorized sick people as all curable from not more than 3 budding plants. I guess some people figure 3 budding plants that take around 4 months to produce medicine out of should be plenty for a cancer patient that i only guess probably uses the medicine daily.I guess some people figure Bob can just rough it out when he runs dry till his next batch is ready since some people are entirly insensative to other peoples suffering.I guess some people would rather go after non violent sick people than actual violent criminals.Medicine is medicine and if it's what is keeping you going then how can a person have too much of it ?

I have no idea how many plants it takes to produce an extract but i know it takes more than 1 orange to make a glass of orange juice and if im growing my own oranges to produce this juice i better have a bunch of them or im not going to have much juice. I bet Bob doesnt want to run out of his medicine and sit around for months waiting for plants to yeild more so he can feel better again. I bet Bob wants to feel better consistantly on a daily basis without the fear of his medicine running out and having to wait for his plants to yeild more because he didnt grow enough to provide consistant relief on a daily basis leaving himself open to negative health impacts. I guess Bob doesnt desire to feel better sometimes but he obviously wants to feel better on a daily basis so he is being responsible with his health by providing an adequate supply of daily medicine. Who are we to stand in judgement of what it takes for Bob to get through the day?

Just about anyone can get a medical card. (I don't have one) I didn't realize state law allowed for growing your own. The guy is legit, he has terminal cancer. The authorities should have a little common sense, compassion, drop the charges and leave him alone to die on his own terms. Other people that are politically connected can grow 24,000 plants, be tipped off by corrupt authorities, walk into RTD and meet the vice-chairman of the Board of Directors with a half a million dollars and RTD will deposit $400,000.00 in a safe deposit box.

I dont think anybody has the right to judge this cancer patients choice of medicine nor do we have the right to judge how much medicine this cancer patient needs. I think we should all wish this poor guy better health and return his property including his medicine and send him on his way with nothing but well wishs and apologys. To limit a persons medicine to below an effective treatment level is in-humane and goes beyond cruel and unusual punishment. The ADA has laws to protect a persons right to use their medicine.And to be considering criminal charges against this cancer patient is absolutly rediculous not to mention entirely shameful. As long as there are possesion restrictions for Cannabis users will continue to go to jail. Innocent people will continue to be harrassed as long as we continue to give law enforcement the tools to do it, >ie, possesion laws.< If Cannabis users dont want to go to jail it will take removing all criminal penaltys for Cannabis to make this happen. More laws that restrict access by providing limitations that are unreasonable are only going to keep supplying the courts with job security.

You, like most inhabitants of the U.S.A, are not fit to be a citizen of it.  The violation of the Constitutions of the country and of Colorado by May and his cohorts is an undeniable fact -- here, staring you in the face is the failure of our democracy.  I'm sure that I'm on their radar -- that is the price for speaking the truth in a nation that disregards its founding principles.  Judges throughout the criminal injustice system issue warrants freely, without adequate cause, but fascists in the Congress have pretended to authorize warrantless searches.  The Fourth Amendment to the Constitution is a dead letter, and the First Amendment is in the crosshairs.

"coming with warrants" is never true, that's they're way of scaring you into granting permission to search the home....

The police practice this stuff, getting you to let them in and do plant counts.  Patients and caregivers should practice 'just saying no' and 'get off my property' when the police arrive.  If they really have a warrant, you'll be in handcuffs in 5 seconds flat before you even knew what hit you.

None will be shown, until it goes to court, your public defender or attorney might get a copy of one that was dated that day and will have no choice but to accept it. The cops do not need a warrant, just a bigger gun!

It's time for the God Damned DA's office and local law enforcement to read and understand the Constitution of the State of Colorado.  Article 18 section 14 .... specifically this part:

(4) (a) A patient may engage in the medical use of marijuana, with no more marijuana than is medically necessary to address a debilitating medical condition. A patient's medical use of marijuana, within the following limits, is lawful:

 

(I) No more than two ounces of a usable form of marijuana; and

 

(II) No more than six marijuana plants, with three or fewer being mature, flowering plants that are producing a usable form of marijuana.

 

===>(b) For quantities of marijuana in excess of these amounts, a patient or his or her primary care-giver may raise as an affirmative defense to charges of violation of state law that such greater amounts were medically necessary to address the patient's debilitating medical condition.

Seems pretty clear that the local law enforcement and DA's office are setting themselves to provide a lifetime's of wealth to a patient that has been harassed passed the point of reason.

Please Please sue the fuck out of them.  Somebody needs to stop this harassment of patients and caregivers !!
