ACLU urges schools to adopt policy banning school police officers from working with ICE

The American Civil Liberties Union has jumped in on the debate simmering in Carbondale and Glenwood Springs over whether school resource officers should be allowed to collaborate with federal Immigration and Customs Enforcement.

In a letter sent to the Roaring Fork School District board, the ACLU sides with immigrant-rights groups.

From the letter:

When SROs work in collaboration with ICE, that very act discourages families who have undocumented members from sending their children to school for fear that the SRO will use his position to gain information to share with ICE.

The focus of the debate has shifted lately toward making more sweeping policy changes and away from condemning the alleged actions of a single officer, Carbondale cop Alvaro Agon. Last month, the Colorado Immigrant Rights Coalition raised concerns about Agon's dual role as the school resource officer at Roaring Fork High School in Carbondale and his previous position as the Carbondale police department's liaison to ICE.

"We have some cases documented of him questioning students about their parents' status," CIRC organizer Brendan Greene said. "We have instances of him deporting family members of parents and students at the schools. Then, those same children have to see him at school in the following days.... It makes them not feel safe at the school."

Rebecca Teitelbaum Wallace, a staff attorney with the ACLU of Colorado, says the ACLU first heard of the issue from Greene. "We read many of the summaries of CIRC's interviews with residents of Carbondale who had been effected by the local SRO collaborating with ICE," Teitelbaum Wallace says via e-mail. " We then sent an open-records request to the Carbondale Police Department and confirmed that Carbondale's SRO had directly collaborated with ICE on numerous occasions, resulting in the beginning of the deportation process for many residents."

Agon is also the subject of a lawsuit regarding two men who were questioned by ICE at a June carnival connected with Glenwood Springs' Strawberry Days festival. It alleges that Agon is an "ICE informant" who designated two fathers whom he knew from his work at Carbondale Middle School "for pick up" by Garfield County deputy sheriffs.

Local police chiefs have defended their practices, explaining at a press conference covered by the Glenwood Springs Post Independent that the local police are not concerned with residents' immigration status -- just their criminal activity. But sometimes the arrests of undocumented immigrants lead to their deportation, they said. "We only enforce the law," Carbondale Police Chief Gene Schilling said, according to the Post Independent. "It doesn't matter who the person is or where they're from, and it's not a race thing."

But CIRC and the Colorado ACLU say the circumstances surrounding the arrest and deportation matter less than the fact that school resources officers are involved. "When SROs collaborate with ICE, regardless of the police department's asserted intent behind the collaboration, the message to the community and students is clear: that the SROs are working to enforce federal immigration law," the ACLU wrote in its letter.

It's now up to the Roaring Fork school board, whose members have said they would be willing to consider a policy that bans school resource officers from collaborating with ICE. Their next meeting is October 26.

In the meantime, CIRC is hosting a public forum at the Orchard Church in Carbondale on Thursday at 6:30 p.m. to discuss the issue. "The town forum will focus on bringing out the issues and speaking about it in public," says CIRC spokesman Alan Kaplan. "We're inviting the school boards, the sheriffs, Alvaro [Ago] and everyone to come out and say their piece." They've also invited the immigrant community, several of whom first reported concerns about Agon. "It's going to be an interesting event," Kaplan promises.

 The last time I checked (and it has been a couple of years) the school was required to educated all children legal or not. AND they were not allowed to ask if they were legal or not.

Therefore, this guy should not be allowed to do both roles. It violates the rule of asking if the student is legal. Students should feel safe in school. By extension, they should feel safe about their parents.  Let the ICE figure out another way. It is a conflict of interest.

How you feel about immigration laws is beside the point.

The same people who pay 3x's what nationals pay in federal, state, SS/Medicare under the basic opportunities provided under "work" programs. As a direct descendant of the young pilgrim William Sherman, my family, like yours were outcasts from their motherland, too. Roger Sherman was part of writing and signing all four of our nation's most important documents, creating the covenants for this country. He had close friendships with Thomas Jefferson and Benjamin Franklin. Roger Sherman was one of the first organizing Statesman to openly defy the crown pre-Revolution.

Sherman didn't own or approve of slaves - human or government sponsored. Roger was noted as the Statesman who successfully brought an end to the divisive bickering at the Constitutional Convention about representation. Sherman brought forward the idea of having a congress with equal numbers of federal Senators per State, and a House of Representatives, given by State population. I have other ties as well, but I don't see my lineage as being significant to the modern immigrant heroes, who choose to make America their home. I have no sympathy towards drug dealers, murderers, rapists, thieves, scam artists, drunk drivers, speeders, vandals, tax evaders, jaywalkers or any other criminal that is caught, tried and sentenced for breaking US law. What valid reason is there to treat people who knowingly break immigrations laws any different? I don't care if they are poor, rich, canadian, latino, or moon men. My grandparents were immigrants, they came here fleeing poverty, but they did it the right way. If you want to live/work/go to school/thrive in America, you need to follow the laws of the country. The ACLU in this case is trying to prevent individuals from doing their jobs because they don't have the legal basis to oppose the law itself. Why solve the problem by working towards changing the law when you can just try to convince people to ignore it. On that note, I feel that Speed limits are unfair, and as such discriminate against those of us with cars that are capable of going so much faster than 65mph. I advocate that instead of changing speed limits, everyone just drive as fast as they can, and we form a lobby group (The American Corrective Speed Union, or ACSU) to prevent police officers from handing out tickets!

If it's an unjust law, then provide work to provide the necessary legal justifications and CHANGE the laws, much like was done with slavery. The ACLU advocating people pretend a law doesn't exist does is a waste of time, and changes nothing for the illegal immigrants.

U.S. immigration law says it is illegal for foreign nationls to live and work in this nation without permission, the penalty being fines, imprisonment or both follwed by deportation. The Supreme Court of the United States (SCOTUS) - not the President - interprets the law and congress writes the laws of the land. Thank for the Civil Rights movement, and the ACLU!  Eisenhower's "Operation Wet back" never became law, and is not part of existing US Immigration Law policy. Deportations by ship were halted. Airlifts replaced that method until the late 1950s, but even Stalinist sweeps can't be sustained forever. Add elements of Patriot Act, and the increased militarization of Homeland security with quotas for creating criminals, plus State laws that are not consistent with national policy, and our country has to ask itself, "Is this what we are? A nation built on immigration, choosing to re-write our history criminalizing immigrants with racist, segragationist, Anglo-centric State laws that violate the 14th Amendment." Immigrants are being abused and forced into a cycle of never ending status processing that keeps them paying more in taxes under "work programs", but not given the same opportunities to move beyond work programs, into legal residency, or citizenship.
