Members of the Occupy Denver movement will hold a press conference at 10 p.m. in the wake of Governor John Hickenlooper and Mayor Michael Hancock's announcement that the group can no longer camp out on the grounds of the Colorado State Capitol overnight.

The group issued a press release this afternoon, which you can read below.

EMERGENCY PRESS CONFERENCE: ARRESTS IMMINENT

A Formal Statement of Our Right to Assemble from Occupy Denver

Governor Hickenlooper held a press statement today citing city ordinances at Lincoln Park as the reason for dispersing Occupy Denver: "This is about health [and] safety of the Occupy Denver protesters, and the public."

Without foresight, Governor Hickenlooper contends ordinances and permits override our Constitutional right to assemble.

Occupy Denver would like to redress our grievances regarding a number of issues. In short, we believe that the government controls the people instead of the people controlling the government fiscal accountability, responsibility, and transparency is a requirement of responsible government the current debt load and the economy should be immediately addressed campaign fraud must end

Even if you do not agree with our political position, please support us in our First Amendment rights to peacefully assemble and redress our grievances - we would do the same for you.

We send an open invitation to City, County, and State officials to come and give a statement. This includes, Governor Hickenlooper, the Chief of State Patrol, and City Council members. Please join Occupy Denver at a press conference this evening, October 13th, at 10:00 pm to further discuss our Constitutional right to assemble.

Unless you are a billionaire you should be behind the Occupy movement.  If you AREN'T a billionaire and you AREN'T supporting the movement you ARE an idiot.

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

I guess the Bill of Rights is no longer valid in Colorado, or the rest of the country? Are these homeless / campers or are they a group of people who have peacefully assembled to petition the Government for a redress of grievances?

Legal representation offered to any nonviolent person arrested or cited while exercising constitutional rights on State Capitol Grounds by Robert J. Corry, Jr., Attorney at Law, 600 Seventeenth Street, Suite 2800 South Tower, Denver, CO 80202, phone 303-634-2244, Robert.Corry@comcast.net, successfully defended 2008 Democratic National Convention protesters.

Come participate, express solidarity, and/or help to chronicle whatever happens in Lincoln Park tonight at 11pm with your smartphone or camera -- the sidewalks surrounding the Park are public property too, and open twenty-four hours a day!

P.S. One minor correction is in order -- Occupy Denver cannot itself redress grievances; we are asking our government to redress our grievances.

P.P.S. I do not expect or condone a violent confrontation, and I believe that it is safe to come to the Park tonight.

Time, Place, and Manner? What's the legal argument?

They do appear nervous and guilty, whereas Hancock is shameless (in the video announcing action against Occupy Denver tonight)..

Lawyer Needs Bailout
Lawyer Needs Bailout

Discriminatory content-based restriction on rights of freedom of speech and assembly, and right to petition government for redress of grievances.  Thousands of people camp there every day of the year and are undisturbed, then all of a sudden people camp out while expressing themselves, and the government suddenly cares.  A trial will accentuate the message, people will not be silenced.  Consequences?  How about the consequences for CEOs who ran their companies into the ground and WE bailed them out?  Jury trial? Bring it on!

Didn't realize CEO bailouts were part of a valid, content-based constitutional argument, but oh well...
