Immigration review pilot program that may close low-priority cases coming to Denver

Local immigration advocates are cautiously optimistic about a pilot project to review open immigration cases in Denver and close those deemed to be of low priority. The program, described in this New York Times story, comes on the heels of a memo from the head of Immigration and Customs Enforcement to use discretion in cases such as those of undocumented students.

The pilot program will begin in Denver and Baltimore on December 4 and last six weeks. An Immigration and Customs Enforcement (ICE) document provided to Westword describes the program like this:

Over the course of the six- week pilot, an intra-agency team of attorneys from ICE, USCIS, and CBP will review the cases on the non-detained dockets in the Denver and Baltimore immigration courts based on the Prosecutorial Discretion Memorandum and guided by a set of more focused criteria. During this time, DOJ's Executive Office for Immigration Review (EOIR) has agreed to shift judges from the nondetained docket in those jurisdictions to hear detained cases, in order to enhance the processing of such detained cases.

Another document provided to Westword called "Guidance to ICE Attorneys" lays out the criteria for reviewing the cases. It says that cases in which an immigrant is a suspected terrorist, a convicted criminal, a gang member or a repeat offender should be prioritized for possible deportation. On the flip side, cases in which an immigrant is a child, a senior citizen, a high school graduate, a member of the military, a crime victim, an upstanding citizen or has family members who are U.S. citizens should be considered low priority.

The pilot program is scheduled to end on January 13, 2012. Once it's over, the ICE document says, the Department of Homeland Security "will promptly review that data and other implementation outcomes and, where appropriate, consult with (the Department of Justice) to determine, on an expedited basis, the best methods to implement these processes on an ongoing basis nationwide."

The Colorado Immigrant Rights Coalition says it's encouraged. In a statement, CIRC president Ricardo Perez said, "The fact that one of the review teams is based in Denver will give us an opportunity to monitor their work, inform our communities about the process, and see firsthand what the impact of this review becomes."

Federal officials have not commented on why Denver was chosen as a pilot program site.

However, CIRC spokesman Alan Kaplan says it's unclear how the review process will work. "The questions that still remain are, how are they going to lift up the cases, what kind of community input there will be and how will this play out?" Kaplan says. "We see the guidelines and we're tentatively excited, but nothing is in play yet."

Several individual cases that have made headlines could be candidates for the review, including those of twenty-year-old Gerardo Noriega, mother-of-three Jeanette Vizguerra and Sujey Pando, who married her partner, a U.S. citizen, in Iowa in 2010.

Soinstead of receiving an answer to your requests weeks after a law has beenpassed, you now have the reliability of having some influence over your US,State or local representatives. The Balance Budget Amendment never passed, soneither party has a commitment to stop the outlandish spending sprees. The larger group of politicians inWashington draft laws to enrich themselves, not the people, which is beinginvestigated. You mustn’t think thatnothing can be done—we voted them into office, we can vote them—OUT.

Unlikemost developed countries illegal immigration is a felony, not a civilinfraction as in the good old USA.  Theyhave caused this incredulous infection that has contaminated our country with alarge chunk of discretionary spending, to support these people. That has affectedeach of the 50 states financial shortfalls for decades. The major majorityrealize now that we cannot keep accepting people who are desperate, and placinga strain of financial weight on public schools for their children, thehospitals and an overpopulated penal system.

 

 

No finger is pointed at any person’s race, color orspiritual dedication, but anybody who has arrived here through any means, withintent to grab as much free welfare assistance as possible. A MANDATORYE-VERIFY SYSTEM will deliver relief from illegal aliens in the labor market. RevisedE-Verify is already expelling foreigners who are stealing jobs from the unfortunate22 million workers, even though it has the Liberal press who denies itseffectiveness. Unbelievable the main culprit that had an obligation to theAmerican people through many changes of administration, have failed to closeall loopholes in stringent enforcement. Not even the border fence has beencompleted--or any serious laws to hold businesses accountable for the damage causedby illegal alien labor. You have to wonder who Obama and theDepartment of Justice as our Public Servants are obligated too.  It certainly not to assist the majority of thecitizens and legal residents, as the President and the judicial branch havebeen asserting their power on Arizona, Alabama, Georgia, South Carolina and nowIndiana. All these states want to do is inhibit economic aliens from going thereand ransacking the welfare and public entitlement programs.

 

As of November 18, Rep.Joe Heck (R-Nev.) and Rep. Alan Nunnelee (R-Miss.) is now co-sponsoring House Judiciary Chairman Lamar Smith's LegalWorkforce Act (H.R.2885.) adding to the astounding 12 more lawmakers in thelast two weeks, bringing the number of co-sponsors to 65, who wanting  this law to reach the floor of the house ofRepresentatives.

Whoever answers the phoneexplain to them you are a voter and want your policymaker to sponsor this bill. You can also insisting that all ofCongress, on both sides of the chamber co-sponsor this beneficial Bill. EveryTEA PARTY member throughout America should join in communicating with everystate and US Senator and Congressman.

 

Once we get illegalimmigration under control, then ‘THE People’ can enact a standardized ‘GuestWorker’ program’ for agriculture, but with good regulated pay, conditions thatmust be observed. Not the incorrigible way some farmers are treating their chargestoday.
