• Any conviction results in 6 month drivers license suspension.
• Possession of less than one ounce of marijuana is punishable by up to six months in jail and a fine up to $1,000. For possession of one ounce or more the penalty increases to up to one year in jail and a fine up to $2,500. Amounts of one pound or more carry a penalty of up to five years in prison and a fine up to $5,000. Possession of greater than 100 pounds is punishable by 1 - 15 years in prison and a fine up to $10,000.
• The penalty for sale or delivery of marijuana is up to five years in prison and a fine up to $5,000.
• Also interesting to note: Paraphernalia possession is considered misdemeanor punishable by up to 6 months in jail and a $1,000 fine on first offense.
Wyoming:
• Using or being under the influence of marijuana is punishable by up to 90 days in jail and a fine up to $100.
• Possession of three ounces or less of marijuana is punishable by up to one year in jail and a fine up to $1,000. Possession of greater than three ounces carries a penalty of up to five years in prison and a fine up to $10,000. First offenders may be placed on conditional probation and may have the proceedings discharged.
• Sale or delivery of marijuana is punishable by up to 10 years in prison and a fine up to $10,000.
Nebraska:
• 1 oz or less (first offense) is a civil citation with no jail time and up to a $300 fine.
• 1 oz or less (second offense)is a misdemeanor with up to 5 days in jail and up to a $400 fine.
• The penalty for distribution of marijuana is up to 20 years in prison and a fine up to $25,000.
