Legalize 2012 marijuana re-legalization proposal ready for public comment

Cannabis activist Laura Kriho has a message for medical marijuana business people shaken by seizure letters sent to 23 dispensaries by the U.S. Attorneys Office and worried that centers faced with closure will have nowhere to move: Stop burying your head in the sand and get behind Legalize 2012's proposed ballot initiative, which will be available for public comment through Monday. Kriho says the proposal, dubbed the Cannabis Re-legalization Act of 2012, offers "true legalization," as opposed to the Regulate Marijuana Like Alcohol Act, which has already submitted 160,000 signatures toward landing a place on the November ballot.

"We remove all of the criminal statutes related to marijuana," she says. "It sets up an independent commission composed of cannabis experts, who'll implement the rest of the law and write commercial regulations -- and our qualification for commercial regulation is that it not be onerous and burdensome. That's the situation we have with 1284 and Initiative 30" -- the bill that regulated medical marijuana and another designation for the Regulate act, respectively. "They make it so only a few rich people are able to participate in the process."

In addition, the Re-legalization Act "establishes cannabis as a fundamental right in Colorado" -- an issue that came to the fore due to a court case involving Jason Beinor, a medical marijuana patient who lost his street-sweeping job after testing positive for pot. "That's why Amendment 20 is falling down in the courts, and we clear that up. Initiative 30 doesn't make cannabis a fundamental right, so it could fall down on the same grounds."

Public comment by visitors to Legalize2012.com is encouraged through January 16 -- and Kriho offers an example of how receptive she and fellow backers are to suggestions. "I just put in some language after a dispensary owner wrote us, saying it would put him out of business. We put in a clause that said it wouldn't do that."

Granted, this tweak didn't satisfy the owner in question. According to Kriho, "What he was really concerned about was legalization ending his monopoly on having a dispensary, and opening things up to more competition. And we can't help that. The intent of it eases up regulations on dispensaries, but his government-sponsored monopoly is soon to be over."

The final language for the Re-legalization Act will be submitted to the Colorado Secretary of State's Office shortly after the public comment period ends on Monday. Two to four weeks later, by Kriho's estimate, the state will give its blessing, and signature collection can begin.

This is a tall task. Kriho was involved with all-volunteer petition efforts for marijuana proposals in 1992 and 1994, and while participants gathered as many as 65,000 signatures, it wasn't enough. To gather the 85,000-plus certified signatures required by the state, then, paid petitioners will be necessary. "If people want to see this on the ballot, they're going to have to put up some money," she says.

Current action by the U.S. Attorneys Office shows why doing so is a good investment, Kriho believes. "The harm is continuing," she says.

What is up with the clause to only allow "cannabis advocates who have been involved in cannabis advocacy for at least  tens years" That seems like it would limit that panel to a small group of people who do not have the skills to work with others, and thus spelling a recipe for disaster.

If anything marijuana should be legalized and alcohol should be made illegal. I believe that hard core drugs like cocain, meth, heroin, etc, should all stay illegal, but marijuana is not a "hard core" drug. Alcohol is much worse than marijuana and we have legalized it. Here's some facts to support my statement.

There are hundreds of alcohol overdose deaths each year, yet there has never been a marijuana overdose death in history.

-Excessive alcohol consumption is the third leading preventable cause of death in the United States and is associated with multiple adverse health consequences, including liver cirrhosis, various cancers, and violence.

-Almost half of all traffic fatalities are alcohol related. (20 percent of alcohol-related traffic deaths involve blood alcohol concentration levels below .10 percent.)

-If an alcoholic suddenly withdraws from alcohol, he or she may suffer delirium tremens. D.T.s sometimes end in death.

-Many people who apparently die from overdoses of sleeping pills (barbiturates), actually die from a combination of alcohol and the medication.

-One quarter of all emergency room admissions, one-third of all suicides, and more than half of all homicides and incidents of domestic violence are alcohol related.

-Between 48 and 64 percent of people who die in fires have blood alcohol levels indicating intoxication.

-Alcohol is abused by some 14 million Americans and contributes to the deaths of 100,000 each year.

-According to the National Highway Traffic Safety Administration, 65 percent of fatal drunk-driving deaths involve drivers whose blood alcohol concentration (BAC) is .15 or higher.

-The risk of hemorrhagic stroke is three times higher among heavy drinkers.

-Large amounts of alcohol (such as a quart if drunk in five to thirty minutes) may occasionally cause death by anesthetizing the brain center that controls breathing.

-About 20 percent of those people who commit suicide are alcohol abusers, according to the National Mental Health Association.

-About 20 percent of suicide victims are alcoholics.

-Alcohol is clearly the drug with the most evidence to support a direct intoxication-violence relationship. Cannabis reduces likelihood of violence during intoxication... There are some physical health risks, particularly the possibility of damage to the airways in cannabis smokers. There has never been a documented case of lung cancer in a marijuana-only smoker, and recent studies find that marijuana use is not associated with any type of cancer. The same cannot be said for alcohol, which has been found to contribute to a variety of long-term negative health effects, including cancers and cirrhosis of the liver.

Looks great so far. Will read again and look for input. Very straight forward aggressive approach to Re-Legalize. I believe CO will need support from people of every state. I'm in California and will tell all of my Colorado friends to back this measure. I've already posted out on several of my social networks. There are several dispensary owners in CA that are now against "Legalized Cannabis" too and it is very hypocritical and unfortunate especially since they could then open their doors to everyone and without need to show an "MMJ card". This initiative is a very good thing for the US as the vast majority of the adults here consume alcohol or are in a position where they could be affected by other people who consume alcohol.  For these people, a great deal of death, violence and disease could be prevented by legalizing adult marijuana sales.

Marijuana has repeatedly been proven to NOT cause cancer, heart disease, brain damage, liver disease, emphysema, violent rages or any other significant health issue, and its addiction potential is about on par with coffee. Alcohol consumers deserve the right to switch to the FAR safer recreational drug, Cannabis.

I have to give a big thumbs up and say I support Legalize2012 100% because it aims to legalize cannabis, not further regulate cannabis which has been an utter failure for the State of Colorado.  I think Laura Khiro and the L12 crew have done an amazing job of listening and watching the developments and failure of medical marijuana in Colorado over the past few years and they see the future of Cannabis as real legalization, not regulation.  I believe that NORML will fully support this measure in the near future as this is an attempt at true legalization.  L12 is easy to read and makes sense.  I will vote for this measure and promote it on http://420.co  Keep up the good work Laura, you have achieved ganja goddess status!

This ballot initiative offers the only answer to the federal harassment that we are currently seeing in Colorado. We hope that anyone who currently provides cannabis under the state law will use the Legalize2012 Campaign as a rallying point to fight back politically against the DEA's interference in state's rights.
