Medical marijuana ban: All Fort Collins dispensaries must close by midnight

There's no love for medical marijuana dispensaries in Fort Collins today. Thanks to a voter-approved ban on medical marijuana businesses, all centers and grows have to be shut down by midnight tonight.

Seargent Jim Byrne, speaking for the Fort Collins Police Department, said officers plans to be busy today performing last-minute inspections on the dozen-or-so shops that have remained open until the very last minute. When the clock strikes twelve, shop staffers must hand over any leftover product if they want to remain in good standing with the Medical Marijuana Enforcement Division and potentially open another shop in the future. Any marijuana found on-site after today could warrant criminal charges.

"They want to stay open as long as they can. It's a business, and we get that," Byrne noted. "Business owners have been very cordial and cooperative so far. We get where they are coming from. We just let them know that it's not us; we are just the moving company here."

Several centers had kept operating in the hope that a last-minute lawsuit filed by attorney Brett Barney on behalf of five dispensary owners might lead to a temporary injunction. But the presiding judge ruled earlier this week against Barney's clients, allowing the ban to move forward.

"The net effect of it is that my clients aren't going to get any recourse in Larimer County," Barney said. "As of right now, they are all planning on shutting down in compliance with the city's ban. Not sure if we'll be appealing the court's decision, but this certainly isn't good for patients or the industry in any way."

According to Barney, the judge considering the lawsuit looked as if he had already made up his mind before the trial began, noting that he read from a written statement during the ruling. "It seems like the conclusion was forgone," he said. "I thought we had a judge who believed in the constitution. But we failed in that, too."

Folks at most shops contacted this morning didn't answer their phones -- either that or the phones had already been disconnected. However, a manager at Medicinal Gardens of Colorado, which was open today, said that the crew plans on shutting down at 7 p.m. tonight as usual, then transferring remaining product to Denver for the grand opening of High Street Growers, a new shop on Federal. The manager said she was sad, but felt fortunate that Medicinal Gardens had an option.

Others aren't as lucky. An owner at Elite Green Organics was planning on staying open until 2 p.m. today, then dissolving his LLC after the police completed a final inspection at 3 p.m. He said he doesn't plan on having any herb left to hand over to the police and is clearing out the roughly two pounds he had left at $70 an ounce. Before the shop could even open, he said he had six people in line outside, ready to buy.

But the ban hasn't meant an end to every shop near the college town. Just outside the city limits, near I-25, Choice Organics owner Erica Freeman has been spared from the ban by being grandfathered into her location by the county. Freeman said she plans to remain open to serve patients left stranded by the ban.

Representatives of several centers, as well as members of the local United Food and Commercial Workers, plan to work toward repealing the ban through the ballot initiative process.

And I havent had an asthma attack since. Prescription drug overdose whether intentional or unintentional, kill numerous thousands of people every year, yet there has never been a recorded death ever in the history of man resulting from smoking marijuana. Heaven forbid we have local families growing and selling. Heaven forbid America stops the marijuana being smuggled and sold here at the profit of drug cartels. Heaven forbid a person with severe pain do anything besides take a pain pill with a laundry list of devastating side effects. I have never used a drug in my life, prescribed or otherwise. If adults are willing to use this for whatever their reasons are and they are responsible in their use I completey support a local sustainable approach to it. The use of mj isn't going to go away because dispensaries are banned. It's just a government's way of turning a blind eye to what goes on every day. With or without their approval. Great way to handle a situation. Maybe it will all just go away if we ignore it.

I live in a MEDMJ state.. what happens here is nice.  I am a legal registered MMJ patient.  I won't bore you with my chronic pain problems.  But I will tell you the local police dept. handles complaints by ignorant neighbors and citizens very well.  Basically what happens is this: local PD verifies if you are within the law as written and that you are in compliance.  Then when you are exonerated, they give notice to the complaintant that there is no violation.  You would think it would end there.  But it doesn't.  The complaintants persist.  But guess what?  Because you comply with the right to provide yourself (grow) with MMJ under state law and don't violate the generosity to choose to be legal, the local PD issue warnings to the complaintant (s).  On a 3rd complaint, the local PD notifies them that any more complaints will end in harrasment charges and arrest.  Moral of the story: Follow the law and the law will protect you.  Break the law and pay the price of incarceration.  Our system is far from perfect, but the local PD will explicitly tell the people who attempt to usurp an individuals rights will go to jail if they persist with complaints.

What disease does Scoot have to deal with? What prescription drugs does he have to take that does not help his disease process? How is his quality of life compromised by disease? Does he have to worry about waking up in the morning and realizing he can't get out of bed, can't walk, can't move his arms, can't see out of one or both eyes? Does this Scoot guy have to endure debilitating tremors or pain? Does he live every day knowing that will most likely have to use a cane or be wheel chair bound in his 40's??? Does his child get angry at him because he HAS to sleep instead of spend time with his child because of his chronic fatigue?? It seems that he has none of these worries or concerns. If you have not been there, Scoot, then how can you have such a strong opposition??

How many are fighting for not only their lives but for QUALITY of their lives that are left? You might want to start thing for yourself and stop repeating what you have been hearing form those who seek to control you for their profit!  Being a drug dealer is not always a bad title to have.  It depends on the drug you are selling.  Alcohol kills daily, while cannabis has yet to kill anyone...just as one example.

The next time you go out "drinking", how about stating what you really are doing...Going out to "do drugs".  Alcohol is a drug and if you consume it, you are doing drugs...if you sell it, you are drug dealer.

 Panel kills bill to create med-pot "bank" 

A bill to create a first-of-its-kind financial system for medical marijuana businesses in Colorado collapsed Tuesday after being pummeled with questions about what it would actually accomplish.

The Senate Finance Committee killed Senate Bill 75 by a 5-2 vote after about three hours of testimony and debate. Supporters had hoped the bill would extend banking-like services to the medical-marijuana industry, which has largely been blocked by federal regulations from using traditional banks or credit unions

The bill would have allowed state regulators to authorize the creation of novel "financial cooperatives" that could take medical-marijuana accounts.

But the wheels came off when state officials testified that the state commissioner of financial services would not approve such entities over insurance concerns and that other regulations would likely continue to prevent medical-marijuana patients from using credit cards at dispensaries. 

Questions arose over whether other banks could accept checks written on the cooperatives' accounts.

By the end of the hearing, even the bill's sponsor, Sen. Pat Steadman, D-Denver, was resigned to the likelihood that his bill couldn't solve the problem he hoped it would.

What; are you now shilling for the DP?  I testified at the hearing.  The problem with SB12-075 was that there is no way for businesses trading in medicinal cannabis to access the payment system -- dispensaries are unable to pay their bills, except in cash.  Senator Johnston kept trying to cajole the fascist pigs to acknowledge that the bill's remedy would address the pressing public safety concerns posed by these all-cash businesses -- unsurprisingly, they would not:  the prohibitionist animals WANT violent criminals to victimize dispensaries in order to try to revive the claim that drugs cause crime.  The Attorney General's office, the North Metro Drug Task Force, and the Colorado Association of Chiefs of Police are violent, criminal institutions -- the people misdirecting the police power against the People of the United States should be beyond the protection of the laws; they are not fit to walk the Earth!

Our attorney general is very good friends with them. The moratorium is illegal; Ft. Collins had until July 1 of last year to institute such a ban.  C.R.S. 12-43.3-103 (2) (a)  states:  "PRIOR TO JULY 1, 2011, A COUNTY, CITY AND COUNTY, OR MUNICIPALITY MAY ADOPT AND ENFORCE A RESOLUTION OR ORDINANCE LICENSING, REGULATING, OR PROHIBITING THE CULTIVATION OR SALE OFMEDICAL MARIJUANA.".

Robert,I'm curious if there is a way to creatively circumvent this unfair action on the part of Ft. Collins. Maybe like providing a free shuttle service to certain Boulder/Denver area dispensaries for patients located in Ft. Collins. Something along the lines of what the casinos do but with the aim of patients being able to purchase quality meds. We'll call it the "Cannabus"!

Maybe -- I think that the failure of proponents of medical cannabis to raise the issue of the untimeliness of the moratorium was a strategic mistake which may have cost patients' their access to medicine.  A bus service costs money, and herding patients aboard a bus potentially threatens their confidentiality.  The trip might not be much fun either; official and unofficial highwaymen would be tempted to waylay the bus and its passengers, for the purpose of harrassment, robbery, or both.

With over 100,000 MMJ card carrying patients on the loose out there this November's election will be interesting. The federal government is not looking out for the rights of the American people. and have a very low approval rating not to mention all the crime they commit in our name. So saying it is all illegal federally isn't intelligent. If it is really illegal Federally, then why did the state of Colorado take money from all of the centers, ($20,000.00 in our case) that makes them an accomplice!!! or pimps .... then the state has committed crimes also...... or what would you like to call it, them giving us what we deserve for messing with MMJ and trying to help patients with M.S. and cancer etc........

Clue -- those 100k+ "patients" were always there, even before they got cards. Yet pot smokers have been unable to get enough votes to legalize marijuana, even after decades of huffing and puffing.

Did you even read the license application before you foolishly sent in your $20k fee?It CLEARLY STATES that Marijuana remains a CRIME under FEDERAL LAW, and that no state license would offer any protection from Federal prosecution.

I hate it!  The legislature ignores the Constitution, local governments ignore the statutes, elected officials violate the Law, and no one raises a peep.  Colorado apparently ended up with very many Good Germans (although total deference to those in authority is hardly limited to those of German ancestry).  We need to change the State motto from "Nil sine numine" (which represents earlier generations of Colorado officials ignoring the First Amendment by way of establishing theism) to "Omnes ad hoc".
