Medical marijuana responsible vendor bill provides legitimacy, says senator

Proposals concerning medical marijuana banking and THC driving standards have gotten plenty of press. But one piece of weed-related legislation has received comparatively little attention thus far: Senate Bill 154, aka the responsible vendors bill.

What would it do? Here's Senate Lois Tochtrop, the measure's sponsor, with the details.

"This is going to give the dispensaries more legitimacy," Tochtrop says.

Specifically, the legislation would direct the state to authorize a server and seller training program with a core curriculum focusing on licenses, records keeping, privacy issues, criminal liability, acceptable forms of ID and more. Taking part would win shops brownie points with the state: If a business committed a regulatory violation, participation in the program could be used as a mitigating factor when doling out sanctions.

To Tochtrop, the benefits are obvious. "There's so much negativity around the medical marijuana industry, and I think this will help," she says. "It puts guidelines on servers that they can work with -- gets people educated, and brings more clarity."

What about the cost?

"There is no fiscal impact," Tochtrop maintains. "The fiscal note shows that there could be a possible reduction under the state revenue system if the enforcement division brings an action but fines are lower, and that's all. It's not cash-funded." Rather, those going through the program will pay for it.

Thus far, Tochtrop has not heard much opposition to the measure, and she thinks that's telling. "People seem to forget that way back in 2000, the state voted for medical marijuana," she points out. "At that time, I was a state representative, and after the vote was certified, I got an abstract of the votes in my district, House District 34 in Adams County. And one of the precincts that overwhelmingly supported it was an area where there's a large senior mobile-home park, which I found interesting. They got it: They understood that that in the latter part of our life, we want to have access to this kind of medication."

Later today, Tochtrop expects to discuss the bill with Democratic colleagues, after which she'll circle back to speak with Republican members of the business, labor and technology committee on which she sits; that group is slated to consider the legislation on Wednesday. So far, though, "no one has come up to me and said, 'Oh my God, this is the worst thing ever.' With everything else going on, it's flown under the radar."

That may prove to be a good thing, especially in light of the MMJ banking bill's defeat. Look below to read the bill.

@Jake Browne Donkey and privacy are the same person who occasionally steals other users screen names to confuse readers of the comments. I support this bill as a positive step forward and a non-issue to patient rights as this sort of certification already exists for the alcohol industry. The CBA is not out to get any one and we as a community need to accept that regulations are a part of society the only question is where do responsible regulations stop and over regulation begin? Matt Cook has money in MMIG not CBA and should a private citizen be banned from pursuing employment when he is no longer an employee of the state?

Man, I can't even write a post without others posting at lightning speed. This one is pretty funny, much better than the actual story. Obviously people will have different opinions but today you're either a dispensary overlord or a narc drug dealer. I do not see how this would be bad for MMCs, caregivers or police. It seems it was just an excuse for a few regulars to blog with different names and bitch at each other, I really don't think police would spend the time "Donkey" spends on here, if they do, that's really sad. I feel stupid checking this blog as much as I do. I don't know if these comments are an example of what people think or just an example of what 5 people think, It's hard to tell. I care about really good buds and personal freedoms, this "legitimizing an industry through training" has nothing to do with what I care about. Why are people outside the industry concerned? Does it somehow step on our rights or degrade the quality of weed in this State?

There is no question in my mind that the narcs are monitoring this blog.  I cannot offer proof positive about Donkey_Hotay, but why do you suppose that someone who does not like cannabis would constantly post about it in the manner he does?  His intense personal interest begs explanation. Take just as one example the exchange above -- Donkey_Hotay likes the suggestion that dispensaries should boycott the state system but immediately fires back a series of links to articles about people arrested for cannabis by his buddies on the North Metro Drug Task Force. His attitude is and posts are fairly explicit that people should go ahead and break the law if they dare and that they will be arrested and serve time -- there is no political dimension of resistance or change in his narrative, which is nothing more that the standard law enforcement response to objections to unjust laws: "come on, we'll get you, don't do the crime if you can't do the time" -- the only thing missing from Donkey_Hotay's renditions is the "we", but I think it is implicit in them.

As for the bill it may be inoccuous enough, but there is no excuse for talking about the legitimacy of the industry in Colorado as the Federal government proceeds to close 70% of dispensaries in Denver and declares that none are safe. What we need is support for eliminating criminal penalties for cannabis and political pressure on the Obama administration and Democratic Party at all levels to break with the prohibitionists.

Yes, let's remember that almost none of these dispensaries actually have a license yet, so this is just another way to drain their money from them. I would tell them to piss off if I were a dispensary with no license. Why should they jump through more government hoops until they get a license? Time for dispensaries to boycott the state program until the state lives up to their part of the bargain.

What a WASTE OF TIME. There may not be any MMCs left if you guys don't unite and get the State involved to help you with the FEDS.

This program was inevitable. It's also not mandatory for MMC's and will not require lobbying. I'm not sure why everyone is so outraged. Although I'm sure you're all about to give me an ear full...

We had over 160,000 registered patients and more likely 250,000+ that could easily be patients. If 1% of these people were calling, writing, etc, it would have an impact. The MMCs could be badgering patients to call and also educating them on what is going on. 

They have made no joint effort to reach out to patients period. Instead of incorporating them into service, they lobby for their OWN agenda. The Benoir case has had a HUGE impact; where are the MMCs contributing to this defense of patient rights?

Educating patients, who in turn educate their friends, etc, will start to sway public opinion. If the cronies at the Capitol want to keep their jobs, they will listen. Then they will put pressure on the Feds. Our juries will start to turn as well.

We also participated in the "Day of Action" fyi. The only problem is that is was a "day." This is an ongoing process that must be done over and over again. A "Day of Action" does not make up for a few years of inaction.

So what?  What is mind-boggling is that there is even a single person left in the State still blithering about the all the unconstitutional restrictions and exactions of the General Assembly conferring legitimacy on MMCs; that person is Lois Tochtrop.  It serves as rather poor cover for a payoff to Matt Cook too.
