Kent Denver oral-sex case: Possible lawsuit over student expelled but not charged with crime

Back in February, we told you about a Vail sex assault investigation targeting three Kent Denver students. The trio in question evaded criminal charges in the case, but the story's not over. None of the three is returning to the exclusive, ultra-pricey private school, and the father of an expelled student is threatening legal action in the case, which involves disputed claims of coerced oral sex.

The story comes to us from CBS4's Brian Maass, who obtained "hundreds of pages of police reports, photos, text messages, videos and documents related to the case," not to mention the cooperation of the aforementioned dad, speaking anonymously.

The report quotes a sixteen-year-old female Kent student who says she was in Vail for New Year's Eve when she ran into three male enrollees at the school and joined them at the hot tub in a hotel/condo complex. The boys were naked in the hot tub, and she joined them "because I was cold," she told detectives. "And so I took my shirt off and they all kind of ganged up on me a little bit there...and they kind of took my pants off and so I just had my underwear on, so I got in the hot tub.... I kind of figured I was getting into a bad situation. And they tried to help me take my pants off but I didn't want them touching me so I obviously took my own pants off."

Her bra followed -- but she subsequently donned a jacket and towel and split to meet a female friend before returning to grab her clothes. At that point, she claimed one of the boys took her into a towel room and said the price for retrieving her attire was oral sex.

She admitted to performing the act, only to leave again without her clothes -- and when she returned for them a second time, she said the boys told her she couldn't leave until she did the oral routine with another of the students. And then, her account continues, the scenario was repeated a third time before she finally was allowed to get her outfit and flee.

The girl stressed that the sex wasn't consensual, saying, "I just felt a little bullied into, like, things I didn't want to do." But even she admitted that the male students may have felt otherwise, especially since "I was kind of, like, kissing them." There was also disagreement over whether the boys were inebriated or not; the girl said she'd had a single vodka earlier in the evening. And that's not to mention a polygraph one male student is said to have passed and a text message the girl sent to another student that read, "But u shouldn't have gotten so drunk because I wanted to hook up! But I have this issue with taking advantage of my drunk friends:) eek."

Eagle County District Attorney Mark Hurlbert, who wound up in the national spotlight back in 2003 over the Kobe Bryant sex-crime accusations, eventually chose not to file criminal charges against any of the male students, believing that he could not prove a crime had occurred beyond a reasonable doubt. But two of the boys decided not to return to Kent -- and are apparently party to non-disparagement agreements involving the school -- while the third was expelled.

The father of the latter thinks that while the boys made poor ethical decisions, they didn't do anything criminal, and suggests that the girl cooked up the tale. "She probably was embarrassed to be with multiple boys over the course of an evening," he told Maass. "Somebody found out about it and perhaps she felt bad about it and got caught up in this story."

As for a possible lawsuit, he said, "We have to move towards litigation. How do I fix this? This is simply not fair. We can't let them get away with it. We've got to stand up and hold this up to public scrutiny. I want to seek some sort of exoneration for my son. By throwing them out implies guilt. The school has basically branded him and I have to try to undo that."

 Exactly!  That was one thing that my mother told me growing up...listen to your gut it won't steer you wrong.  She was right!  I think that there is so much sex and violence that these teens see anymore growing up that they themselves do not understand the whole concept of it all.  Hollywood glamours everything and these kids believe it lock stock and barrel.  Even reality tv is scripted but most will believe that all that actually happens just like that on Jersey shore!

She doesn't seem to be telling the whole truth. It seems like she had to think of a story to put together when questioned. If this article has quoted the girl correctly, she took off her clothes to get in a hot tub with three naked guys, then left wearing only a jacket and towel (although the reason she got into the hot tub in the first place was because she was cold)  to meet up with a friend, whom I'm guessing wasn't alarmed that she was wearing nothing but a jacket and towel. She then returns, alone, only to discover the price of retrieving her clothing is to perform oral sex on one of the guys...then she leaves again for some reason sans clothing, but returns again for them and has to service two more guys before she's allowed to have her clothes. Also, the girl sates that she had been kissing the guys and that she had a "single" vodka that night as well. I'm sorry, but the facts just don't add up. It seems to me like this was just four drunk students who lost all inhibition and after the haze dissipated and/or word got out about that night, the girl tried to make it look like she wasn't a willing party in order to avoid being labeled among her peers as a "slut."

Oh I won't argue with you there, the three boys are culpable.  I'm like you and the father, himself... I understand the expulsion, however, if you expel the boys then the girl should be expelled also for underage drinking she admitted herself.  And the minute that little voice told her it wasn't a good idea... she should have listened.

 I myself have a hard time believing she is a victim totally however.... 3 boys in a hot tub, alcohol, and she thought it was probably not a good idea??  She was right. She should have left and came back when it was just not her with the 3. But i do not find that the 3 boys do not have some responsibility in this.  They used it to their advantage and coerced her into things she may or may not have normally done.  Get one started and the other 2 follow like a pack of wolves on a carcass.  They all should be held accountable.  Expel one then expel all!

Sorry, as a victim myself... I am having a hard time seeing her as a victim, three times, why didn't she take her clothes the first time she left, a jacket and towel...hmmm this just isn't sounding right.

I am shocked, saddened, and concerned about the actions of my alma mater. It was incredibly poor judgment to kick the boys out but not the girl. I'm afraid that dark days are ahead for Kent, including enrollment and financial setbacks. Leadership must be held accountable for this debacle.

I've read the article.  First, Daddy isn't going to file a lawsuit.  The "But she did it too" argument isn't a winner and it just compounds the fact (which is apparently generational in that family), that it's ok if you and your buddies take advantage of someone who is weaker and emotionally vulnerable.  Three manipulative and predatory boys against one very, very, insecure girl.  That's what the facts tell.   It's a teachable moment, and Daddy has chosen to teach the following:  It's ok for you and two of your buddies to take advantage of one insecure girl as long as everyone gets the same punishment, and I'll make sure that everyone's name is in the Headlines to do it.  That's quite a lesson.   The bottom line is;  the kid's responsible for his own actions, and the consequences.  Daddy can whine and sue about the consequences all he wants, but getting the girl kicked out won't change his son's behavior or the public's view of it.  And suing isn't going to get his kid reinstated or change the school's policy.  He admittedly engaged in behavior that justifies expulsion.  Finally, he can kiss alot of his kid's college opportunities goodbye.  Colleges have a tendency to shy away from applicants with parents who like to sue their kid's schools.  Well played, Daddy, well played.

How about the girls lack of judgement and character? She blatantly chose on two different occasions to return to the area where the guys were. Then, she proceeded to give head to  not one not two but three different guys, she even admits that the boys probably thought it was consensual because she was kissing them in the process. Her story doesn't add up in so many places. She later goes on to say that the boys were "really drunk" and she didn't call for help because he friends phone "wasn't working". But her friend who was nearby when all this occurred said her phone was working fine and the boys didn't even seem intoxicated. On top of that, she sends out a text to another guy 12 hours after this "traumatic event" took place and told him she wanted to hook-up. That doesn't bode well for the so-called "victim".  It's probably easy for you to side with the girl because it's politically correct, but when you break it down this sounds like a slutty girl who got way to caught up in a sexual situation and, after she was confronted with the story, she tried to make the boys look like monsters to save face. The point of this article is not for the readers to take sides but to simply inform the audience that the father of the boy is probably taking legal action against Kent Denver for expelling the boy and not the girl. They both engaged in underage drinking and sexual activity and they should both be punished equally. Even if she claims it wasn't consensual  an investigative team already ruled out that there wasn't enough evidence to press charges. So now it's her word against three boys. You choose....
