James Holmes threatened professor, said he wanted to "kill people," DA says

James Holmes "had conversations with a classmate about wanting to kill people in March 2012" and "made threats to a professor" at the University of Colorado according to a motion written by prosecutors (and on view below). The motion, which was made public today, says "evidence gathered so far" includes that Holmes "failed his graduate school oral boards" in June and was "denied access to the school" after making the aforementioned threats.

The motion echoes what Chief Deputy District Attorney Karen Pearson said at a court hearing yesterday. However, a spokeswoman for CU-Denver, where Holmes was studying neuroscience, told Westword that he was not banned from campus. Instead, he was denied access to portions of it because he was in the process of withdrawing from the neuroscience program.

The motion was filed on August 14 in response to a motion from Holmes's defense attorneys to quash a subpoena for Holmes's educational records. Prosecutors sought to subpoena Holmes's grad school application, "all class schedules and transcripts of grades" and "all oral board examination documents and testing materials generated and utilized by CU staff relating to James Holmes." In their motion to quash (also on view below), Holmes's public defenders wrote, "The prosecution is seeking these materials as a mere fishing expedition and not for any proper purpose."

Prosecutors countered with a listing of "evidence." Here's the quote from the motion:

Evidence gathered so far indicates: (1) the defendant had conversations with a classmate about wanting to kill people in March 2012 and that he would do so when his life was over; (2) that he failed his graduate school oral boards at the University of Colorado in June 2012; (3) that he was denied access to the school after June 12, 2012, after he made threats to a professor at the school; (4) that he subsequently started the process to voluntarily withdraw from his graduate studies programs and was in the process of completing that withdrawal at the time that the offense occurred; (5) that after he was denied access to the CU-Denver Anschutz campus, he began a detailed and complex plan to obtain firearms, ammunition, a tear-gas grenade, body armor, a gas mask and a ballistic helmet, which were used in the commission of the murders and the attempted murders.

"The defendant's educational records are relevant to the investigation of these crimes, his planning and motive," prosecutors wrote. Yesterday in court, however, Holmes defense attorney Daniel King said his client's motive is "irrelevant."

Judge William Sylvester has not ruled on whether prosecutors can access the subpoenaed information. Last Thursday, the university gave the court an envelope of "approximately 100 pages of non-medical educational records," according to a summary of that hearing.

Holmes is charged with 24 counts of first-degree murder and 116 counts of attempted murder, among other counts, in connection with the July 20 Aurora theater shooting that left twelve people dead and 58 wounded. At a court hearing on August 9, defense attorney King referred to Holmes as mentally ill and said he'd been seeking help from a psychiatrist.

We're only hearing one side here. How much was Holmes bullied and ridiculed all his life because of his obvious cognitive dysfunction. What threats were made against HIM. Schizophrenics are not created by people being nice to them and don't become violent for no reason. He was pushed to the point where he had no option other than suicide when the deadline on his flat ran out. Because of the schizophrenic's behaviour it is common for acquaintances and even parents to wish them dead, the REASON for their behaviour.

 

Then because noone will lift a finger to help, they can end up in a position where suicide is their only option. They see this as deliberate and it can be, not that anyone will admit it AFTER the event. Because the media is not interested in talking to 'nutters' the ONLY way they can get publicity is an act of extreme violence, and filled with hatred toward society, a massacre seems like a reasonable option. So just who is the guilty party? Holmes just pulled the trigger.

 

Question: Just what does one do in a situation is which suicide is the only option imposed by society and the media is only interested in violence, just go out quietly without making a mess, ie cut your wrists in the bath? You see, I just happen to find myself in this position right now. As it stands coercion is the only option that society understands. But with what. Nations use the nuclear threat. But an individual can't do that. However there are other much more minute options

Look at the chart showing murders caused by guns vs other weapons.  It's clear as a day that guns are the problem, the only way we will ever be safe from people like Homes is to reduce the numbers of guns available to the public at large.  Time to re-write the bill of rights to protect the innocent, rather than the crazy gun owners.

It's still difficult to know whether a person will actually kill or not. A lot of us say dumb things about wanting to "kill someone" when we're stressed. I might not know enough about the case, though... it does seem like there were other weird things pertaining to him, and authorities at his school perhaps should have been tracking him a little better.

 @Juan_Leg  I just completed my own investigation on what went down. Total of three shooters.  The alleged shooter fired one shot into the air but never actually shot anyone. He believed he was part of a training exercise meant to scare people. He was mad at CU and that is why he was used as a dupe. The other shooters were all black racists hired by the police and military who  targeted whites exclusively. They were recruited by military pysops out of Ft. Huachuca in Arizona. Read the history of that base and it will make sense. North Aurora is very anti-white. The government has brought in tens of thousands of Ethiopians, Somalians, Sudanese and Iraqis who are easy recruits to complete the massacre. The Jewish alleged shooter never shot anyone himself. This was a reply I made to an ABC (Australian) music presenter in response to an email I sent ALL presenters about contempt shown me for 30 years.  He said he though my email was spam.

 

It is most certainly NOT spam.  I have sent one to EVERY ABC presenter about their abuse over many years of someone they see as a nutter and how this abuse may contribute to extreme violence when the abused of the Earth CANNOT get justice without publicity.  My advice is to read it.  Lucky Oceans is a music presenter and also an abuser as he has treated me with contempt by not acknowledging that he received material from me, ie 3 CD's of music that I spent months producing 4 years ago.  THAT is ABUSE and CONTEMPT.  The ABC is a PUBLIC broadcaster and should NOT discriminate against ANY individual based on their opinion about people who send material post comments etc.  It has an OBLIGATION to promote democracy and fairness.  In my case it has not just failed in that obligation but treated me like dirt.  Norman Swan of the Science Show will simply NOT post ANY comment I make no matter what, David Rutledge of Encounter like wise.  I have NEVER been abusive.

 @WhoCares I have said from the very beginning I did NOT believe the only bullets that found human flesh , came from Holmes' gun. No way . Common sense  tells us this when comparing the actions of police agencies all across the nation when slaughter fests occur as this. They panic like everyone else. The difference , they are armed and start firing !!! You don't see many street cops playing , much less winning ,  

on 'Jeopardy '...
