Personhood to pot: Initiative petitions due at Secretary of State's office today

Mason Tvert.
On Colorado Day, August 1, we celebrated fifty reasons why Colorado is the greatest state in the country. Today we're celebrating another one (although many politicians would dispute its benefits): the citizen initiative process, which allows residents to land measures on the statewide ballot, right alongside those put there by elected representtives.

Over the years, citizen initiatives have been responsible for some of this state's most vilified laws (1992's Tabor, or the Taxpayer's Bill of Rights) and most celebrated (Tabor, too).

This afternoon at 3 p.m. marks the deadline for filing an initiative petition with the Secretary of State's office for the 2012 General Election -- and there are plenty of petitions still out there, including another attempt to define personhood and a measure that would allow undocumented immigrants to get driver's licenses.

According to Article V, Section 1(2) of the Colorado Constitution, the number of signatures required for a statewide initiative petition is "at least 5 percent of the total number of votes cast for all candidates for the office of secretary of state at the previous general election." Since the total number of votes cast for that office in the November 2, 2010 election -- when Scott Gessler beat Bernie Buescher -- was 1,722,096, the signature requirement for statewide initiative petitions and statewide referendum petitions this round is 86,105. (It was 76,047 for 2007-2010.) And that's 86,105 signatures that are deemed legit.

So far, the only citizen initiative that's officially cleared all hurdles and made the November ballot is Amendment 64, the measure pushed by Mason Tvert regarding the use and regulation of marijuana, which has considerable support in this state.

And while other petitions might arrive at the Secretary of State's office by this afternoon's deadline, don't expect any more on marijuana -- although at this time last year, there were at least four competing proposals...and a lot of hot air pushing them.

Sorry donk, looks like your boys pushing Initiative No. 70 couldn't get their act together.  I would have voted yes on both.  Perhaps if you spent more time getting signatures for Int 70 instead of trolling westword comments 24/7 it may have had a chance.

@IcePick Only the most daft, slacker-stoner would assert that 1 (one) ounce -- down from Statutory 2 (two) -- and 3 (three) flowering plants, and only for those over 21 is a "best attempt".

A64 = Pathetic FAIL.

@DonkeyHotay A64 is the best attempt yet to end prohibition.  It is not the last but the latest volley by the thinking people.  VOTE YES ON A64 IT FUNDS SCHOOLS NOT DRUG DEALERS.

A64 continues Criminal Prohibition for EVERYONE under 21

A64 continues Prohibition for EVERYONE possessing over 1 (one) ounce

A64 continues Criminal Prohibition for EVERYONE growing more than 3 (three) flowering plants

A64 = CONTINUES Criminal Prohibition

Just a heads up to people reading. Donkey, the prolific anti-MJ commenter is full of bad info.  He has made 100s of anti-MJ posts with false info. He really needs to get a job. If he/she is in fact employed, it is by the anti-MJ lobby.

64 makes it legal for an adult to possess an ounce of MJ, and have up to 6 plants for personal use. That is a great thing. Donkey's strange argument is that people who support the bill are "stoners", then in other posts claims that people should be able to have pounds and pounds, then in other posts he slams the medical MJ industry. This person is working hard to fracture support for 64.  He is very selfish.

64 does in fact legalize MJ. An ounce is plenty. A heavy smoker would take 3-4 weeks of smoking all day, everyday, to finish an ounce. It is NOT a continuation of prohibition. It is the first giant step towards the full legalization across the nation, ending the persecution of good people who would rather smoke MJ than drink alcohol.  Perfect or not, we must vote in support. It is the first step.

If you have your doubts, then read the bill. If you want to possess more than one ounce, perhaps you have a hoarding problem, and you should back up from smoking for a bit. Or, you could just make multiple trips to the store, and have your silly apocalyptic stash.  An ounce is plenty.

If you have a problem with small bits and pieces in the bill, remember that it makes it legal to grow it. When we can all grow it, the law becomes unenforceable. That is the most important part. When a million gardens spring up, it will no longer be an issue. The momentum will take hold, but it must start here.

Voting yes on 64 is the moral thing to do. It is the right thing to do. It is harmful to Colorado to vote against it.

A64 EXCLUDES 10s of Thousands of ADULTS age 18 < 21 from ANY protection whatsoever -- A64 does not allow them to even legally possess 1 gram, or grow 1 plant.

Current Colorado Law allows ANY adult 18 or over to possess up to 2 (two) ounces -- A64 lowers the limit to only 1 (one) ounce, and only for those 21 or older. A64 = retrograde bullshit.

Only an idiot would assert that "an ounce is plenty" for all users and growers in the State.

A64 = dysfunctional, retrograde, worthless nonsense promoted by liars and fools.

@anon "A heavy smoker would take 3-4 weeks of smoking all day, everyday, to finish an ounce." are you kidding?

also, how does 6 plants translate into one ounce? if you are bad at growing pot, you'll get 2 ounces a plant, so at harvest time, the legal user all of a sudden has enough for a felony rap.

@DonkeyHotay -- because according to you, no one is arrested or convicted of a felony for growing a few cannabis plants -- LIAR!!!

DonkeyHotay

@IcePick None that A64 would protect.

-- How many people over 21 are arrested for possession of 1 ounce or less in Colorado? ... ZERO

-- How many people over 21 are arrested for cultivation of only 3 (three) flowering plants in Colorado?

The lying liars behind A64 have not provided a SINGLE CASE, in spite of their OUTRAGEOUSLY FALSE claims of 10,000 annually.

A64 = a worthless turd that protects no real-world marijuana user or grower.

@RobertChase Well then, Poindexter, jump on board your Time Machine and travel back to the age of Negro Slaves so you can wear your Scarlet Letter "D" t-shirt with pride down at the Olde Ale House.

Fact is YOU are not a GROWER, not for yourself nor for anyone else.

Fact is YOU are not a CAREGIVER for other patients.

Fact is YOU have NO FUCKING CLUE as to the NECESSARY quantities and numbers needed to produce and provide any self-sufficient, self-sustaining, consistent, continuous supply of marijuana on an uninterrupted daily basis.

Which -- exactly -- explains why an know-nothing wanna-be like you would support the dysfunctional retrograde turd that is A64.

@DonkeyHotay At the time of the founding of our country, "dilettante" was a complimentary term.  If you'd ever crawled out from behind your keyboard and gone to the Capitol, the CDPHE, the DOR, or Denver City Council when the issue of medical cannabis was under consideration, you would know how ridiculous your accusation is -- as it stands, you address all the other readers here who do not, and some few are duped.  I am proud to advocate for patients and caregivers, and I value their thanks far more than I care about your attempted character assasination.

Especially weak on points of law and real-world application of same.
