Denver's first homicide of 2013: Police arrest suspect for murder on South Alcott (54)

Update, 2:37 p.m.: Denver Police have made an arrest in connection with the first homicide of the new year.

Robert Anthony Rubio, 26, mugshot below, was taken into custody yesterday as a suspect in a January 1st late-night shooting that left one man injured and another dead in Southwest Denver. The victim had turned 21 one day earlier.

Police officials offered the short update today that Rubio has been taken into custody and is being held for "investigation of murder in the first degree."

Officials didn't have any further details on the shootings that took place on South Alcott Street.

The Denver coroner's office identified the victim as Troy Anthony Martinez, 21, who died of multiple gunshot wounds in the abdomen.

The Denver Post reports that Rubio's sister says he only fired shots out of self defense and that a woman and two men entered the suspect's home and started beating him. The sister, who remained anonymous, said she was on the phone with a different brother who was on the scene, when she heard, "'Help me! They're jumping me.'"

The Post says the suspect and the victim both have criminal records with multiple past charges.

Original post, 8:55 a.m. January 3: There aren't a lot of details yet on a shooting that took place on Tuesday night in southwest Denver, but police officials can confirm one thing: It's the first homicide of 2013 in the city. At around 9:40 p.m. on the first day of the new year, officers responded to a report of a shooting at 1044 South Alcott Street. When they arrived, two adult males were suffering from gunshot wounds -- and one died a short time later.

Both of the victims, whose names have not been released, were immediately transported to a nearby hospital, officials say. One of them had non-life threatening injuries while the second victim was pronounced dead soon thereafter, launching DPD's first homicide investigation of 2013.

The Denver Police Department can only confirm that the incident is being investigated as a homicide; in an alert yesterday, the DPD said that no suspect information was being released. And this morning, a DPD spokeswoman says there are no new details yet.

djamison those guys were not just there visiting ther were there because desere took them there for one purpose only and that was to fight because she was angry. at what i dont know but it cost one life and anothers life in prison.she was doing drugs and drinking in front of her kids and had no food in her house to feed those kids.the bros and friend were about to move out because desere was totally losing it doing to much meth and not taking care of her kidsone day she will have to meet her maker and will have to answer to him.she is the criminal in this case but im sure all the drugs she does makes her think otherwise. my heart goes out to the young mans family that died but his blood is on deseres hands!!!! and it cant be changed.


why does the news always have to tell news incorrect. the girl that was involved actually lived there with the 2 brothers and a friend.she did take those 2 young men there to start trouble. if she had not done this then this would never have happened.i hope she can live with this tragedy she caused to 2 families.i put total blame on her!!!!!!!!!!!

Very untrue. she does live there thats the only truth in all of this. Why would this room mate have a gun around children? And the family all had the flu and the 2 victims were visiting the family at the time plus 1 had his neice with him.

The girl who lives there made a bad choice and that was to have the gun man as a room mate before checking his criminal record first!

Wouldn't be that GUNS are more efficient and convenient for their purposes of KILLING other human beings, would it?
