and this is the future of our american gene pool?  white, arrogant, obnoxious, entitled and not too socially conversive.   protected by their brethren and accomplices in the drug trades (of all colors and breeds) like a band of merry malcontents certain of their own worth.  AlQueda need do no further harm, this crowd will do all the damage needed, from within.

@nlday
Really? A bunch of kids smoking pot is worse than AlQueda? Sounds to me like you need to get out more. Make your first stop a mental health clinic.

The Forth Amendment to the constitution protects persons against unreasonable searches. In certain circumstances, warrantless searches supported by probable cause may be reasonable and proper under the Fourth Amendment. Such warrantless searches are acceptable when (1) exigent circumstances exist; (2) the search is conducted insident to an arrest; or (3) consent is obtained.

Because the officers reasonably believed that one or more passengers were smoking pot and alcohol consumption by a minor was involved would not give them blanket probable cause to search all passenger (google search for Greenburg Taurig report of the Atlanta Eagle raid where the city paid nearly $5M settling illegal search and seizure and federal civil right suits) especially luggage in the under carriage compartment or the 2nd and 3rd buses.

It is also unlikely that a court would uphold the bus driver's right to consent to the search of the personal belongings of the passengers. In State v. Miller (1991), 77 Ohio App. 3d 305 -- Hotel room was searched without a warrant after the police were contacted by hotel employees and advised of suspected drugs found in the room. Warrant was required. Hotel could not consent to such a search. Also see State v. Hall (1994), 66 Ohio Misc. 2d 80.

Why would ANYONE bring pot to Colorado ?

It's kinda like buying condoms for your wedding night after the bridesmaids have all gone home .....

No different than being busted for underage drinking. 21 and up. He deserved it. We dont need stuff like this mucking it up for everyone. Granted underage drinking happens but it, sadly, has less of a negative connotation than MJ use.

@Josh Bradley felony is a bit overboard for pot...NO MORE DRUG WAR!!!

It all comes down to respect. Respect my right to smoke marijuana and I will respect your right to not want me to smoke it in front of you. Respect my right to do it in the privacy of my own home and I will respect your right to not wanting me to blow smoke in your face. Respect the laws of the state you are in and most of all children, respect the bus driver!

Stupid Stoners have no respect ... or intelligence.

That's why they're Stoooopid Stoners!

@DonkeyHotay I'm often referred to as a 'Stoner' . Rarely stupid, even when considering I do partake pretty much EVERY waken moment . I may not always be correct,  but NEVER,  do I blame marijuana for any of the extremely limited, shortcomings I may arguably have .

Yes they were stupid. But Felons ? Really ? We couldnt fine them severely, give them a few days in Jail.... We HAVE to charge them with Felonies ? So lets do our best to destroy their future because they were acting like most of the knuckleheads I see attending school in Boulder ? College Kids acting stupid and smoking pot, thats new..... Perhaps we should start doing the same with underage drinkers ? Makem ALL felons I say !

Idiots. If they would have had some respect for the bus driver the first time he asked them to not smoke they wouldnt have had a problem... but instead they want to be arrogant little pricks and that got them busted.

bugsycook

@CoreyDonahue  Corey your problem was and still is - and its why you have been delegated to the sidelines and are now completely ineffective because you are now having to hide down in Mexico - is because you and idiots like these kids from Ohio think that the only way to get your point of view across is to always get up into people’s faces and piss them off. You achieved absolutely nothing with your tactics other than to rack up a criminal record, make a complete total idiot out of yourself and to kill off the Occupy Denver movement. If there ever was a "waste", it is you
