Alex Landau responds to feds' decision not to charge Denver cops who brutally beat him

Organizations hoping to bury unpleasant or potentially controversial news traditionally release information late Friday, in the hope that many folks already in weekend mode miss the development. A classic example: Justice Department reps chose Friday at 6:30 p.m. to inform Alex Landau that they would not be charging the three Denver police officers who brutally beat him with federal civil rights violations. No surprise that Landau is incensed by this turn of events, as are numerous supporters. Look below for details, the lawsuit and more photos from after the incident.

As Joel Warner reported in detail for his 2011 feature article "Black and Blue," Landau was a nineteen-year-old Community College of Denver student when he was pulled over by police on January 15, 2009, allegedly for making an illegal left turn.

Marijuana was subsequently found on Landau's passenger, a fellow student named Addison Hunold, prompting the officers -- identified in the lawsuit as Ricky Nixon, Randy Murr and Tiffany Middleton -- to ask if they could search his trunk. Landau is said to have responded by stepping toward the officers and quizzing them about whether or not they had a warrant -- at which point they began punching him in the face. The attack caused Landau to fall, but the beating continued for several minutes, with one officer yelling, "He's going for the gun." (Landau was unarmed.) Once they finally stopped the assault, one officer reportedly put the following question to him: "Where's that warrant now, you fucking nigger?"

A lawsuit over the incident was filed in January 2011, and Landau eventually received a $795,000 settlement from the City of Denver for the damage done to him. But officers Nixon, Murr and Middleton still have not been punished for their actions in the incident. Murr was eventually fired for taking part in another high-profile excessive-force case involving Michael DeHerrera, and Nixon, too, was canned in connection with his role in an alleged assault on four women at the Denver Diner, also in 2009. However, he was later reinstated and remains on the Denver police force, as does Middleton.

Last week, a Denver judge ruled that the city could be put on trial for police brutality over the Denver Diner case -- and the officers who pummeled Landau could still face punishment resulting from a Manager of Safety inquiry whose results were delayed due to the federal investigation. But this prospect offers little solace to Landau.

These three cops really need to be fired and charged with crimes, however; not all cops are bad. It's the ones that are cops to have power that give a bad name to the ones that really are cops for the right reasons. There are bad apples in all professions that need to be weeded out, but don't blanket ALL cops with the actions of a few. Whoever is doing the hiring really needs to check the psychology of the people they hire.

You know what the saddest part is? The fact that many readers want to post their story, but are too afraid to do so because they are still traumatized by their incident. One day the cops will be hired on their intelligence and not by how they can beat someone. These postings suggest that the people are not only finished with taking shit from the corrupt cops, but many are willing to respond equally or worse which shows the cops have done many things wrong. I am too traumatized to speak of my torture and assault in Colorado. They are dangerous and worse than all of the criminals combined having the authority they do, it's just not right. Jesus is a loser fuck piece of shit lie they use just to hurt people worse. I hate GOD for what they did to me and how GODLESS helps them evil criminal cops, judges and DA's. How many people in prison are waiting to get out to get even....1000's or 100,000's........reply and tell me what you think.

i had a swat team take me out of my house and cuff me in front of my family and friends and 8 month pregnant wife, no idea what was going on but i cooperated and once i was outside some asshole pig tackled me to the ground, he hurt my neck pretty bad but i managed to break 3 of the pigs ribs with my elbow, at the hospital i was told they where sorry, it was the wrong house and that i was free to go, (i had to provide a ride home) still to this day i have no idea what the hell was the deal but now i carry two 45s and a 9mm on my ankle and i pity the cop that tries to hurt me again because he will be shot until i'm satisfied he is dead. i will never trust another pig, and i teach my children not to trust them either..... all you have is you so get armed stay armed and know your rights.

One of these officers, Randy Murr, was charged with lying about the use of force in a seperate incident. This was the beating of Michael DeHerrera in 2009. Cpl. Murr was terminated, rehired and terminated again. He was just rehired again last month.

the cops in my area are horrible in a different way. due to many police calls on my house (mainly on my renters), i am listed as a nuisance property. they gave me a 1,311 dollar fine and i now have to pay for any police calls. 60 dollars per hour per cop

It isn't just Denver it is epidemic all across the country.  Sadly even though most of the communities try to get rid of bad cops the unions force  them to rehire the thugs.  What is worse is that eventually, and I think sooner rather than later, there is going to be some kind of back lash directed at the communities and states.  If they can no longer get insurance to cover themselves it will bust their budgets or bankrupt them.  Cops themselves are terrified of situations like Dormer retaliating against them.  Don't be surprised if it doesn't happen again.  Dormer only targeted certain people, the next one might be after whomever.

I won't be coming to Denver,that's for sure! I used to work as a police cadet,in a suburb in Michigan back in the late seventy's. The police 'allegedly' followed a shoplifter from a well known mall,past city limits,had him cornered and stuck a shotgun down his crotch,and pulled the trigger. The best thing a citizen can do is get a CPL (ccw). Now you can rig your vehicle with small cameras that will transmit at different locations. Not all cops are bad,but alot of them are power hungry.They don't realize that they are just civil servants,and no more important than the garbageman or mailman.

Fort Collins Police Services, Denver Police Department, these two departments are full of crooks. Pretty sure it's a requirement that you are willing to perjure and beat people into submission to take a job in one of those two forces. We deserve better Colorado, demand the governor close these jokers down and prevent any cop employed there from working as a public servant in Colorado again!

DPD is trying to save some face by paying off the guy instead of prosecuting the real criminals, THE OFFICERS WHO BEAT A MAN'S FACE TO A PULP. @mike1963 I worked as a police cadet,protocol is to murder an unarmed citizen,and plant what is called a 'drop weapon' on them, a knife or an  unregistered firearm. It should be mandatory that volunteers and citizens do random police ride alongs, and should have power to monitor police procedures.Citizens should have more power than cops.
