Marijuana: Nederland's efforts to regulate pot before state don't get far

As Nederland attempts to become the first U.S. city to regulate marijuana since its prohibition, it's clear the road will have its share of bumps. The town's Board of Trustees gathered on a snowy Tuesday night to begin the convoluted process of opening stores to the recreational sale of pot. Members spent much of the meeting discussing potential zoning issues and how and when to initiate a task force.

The Marijuana Establishment Regulation Ordinance, a people's initiative, is a catalyst for the town's decision to eschew the official Amendment 64 Task Force's implementation timetable in favor of its own. The board acknowledged that this group is largely be responsible for recommending regulatory language such as labeling and dual licensing, but local politicians are choosing to move forward with a task force of their own.

As the board struggled to solidify language outlining how many people to include on the task force (seven members, three alternates), a handful of citizens in the audience voiced concern that a process utilizing a task force, and the board's self-imposed timeline, ignores the initiative submitted by the people of Nederland. The meeting was not open to public comment, so the board moved forward with plans to accrue members for a task force to investigate specific zoning regulations, licensing and proximity issues.

The board will have much to consider as it moves forward, keeping one eye on developments at the State Capital, as well as monitoring the federal pulse. But for a town at the forefront of marijuana legalization, it has positioned itself in the center of the fishbowl. The process is an interesting collision of small-town politicking and national implications. Board members are aware of the state's hard deadlines for implementing Amendment 64, but they questioned whether the state would be able to flesh out the full regulatory measures by those deadlines. Should the state fail to do so, they want, in the words of one board member, "to be ready to pounce."

The meeting concluded with few things set in concrete, but Alisha Reis, the town administrator, said that board plans to finalize task force plans by the time of the next meeting, Tuesday, March 5.

Hey, lets do a little Maths here: Chippi and Colibri would allow out of town visitors to buy 5 GRAMS of marijuana, but FORCE them to consume ALL of it before they could stagger out the door. How much pot are we talking about?  An EIGHTH of an ounce is 3.5 GRAMS. Another 1.5 grams, which brings us up to the allotted 5 grams, would make the amount that our out of town friends would have to consume IN ONE SITTING to just under ONE AND A HALF EIGHTHS -- Just shy of a QUARTER OUNCE.

So let's take the Stuka Challenge: In one sitting, Chippi and Colibri will smoke one and a half eighths of top shelf hooch EACH and immediately thereafter they will each drive from Nederland to Denver. 

At the conclusion of this challenge, we shall decide whether their proposal to force out-of-state visitors to consume ALL of what they buy on-premise at the cannabis shop is half-baked, hare-brained horseshit, or stark, raving lunacy.

In other words, Chippi and Colibri attempted to disrupt the meeting they had no say in, and push their personal agenda to trow out of state visitors to the incarceration industry wolves by forcing visitors to consume all the product they buy -- up to the 5 grams they would allow -- at the retail store, and only then turn them loose on the streets, fucked up out of their minds.h


HipTip: Chippi and Colibri are NOT "the people of Nederland". Shame on Westword for pushing this obvious propaganda lie.

It's really great that the mountain communities of Colorado have such a high reputation for forwarding cannabis into the hands of the waiting consumer and tourist.

@CoreyDonahue Better yet--Complete shock for me as an activist--We found out last night that Twirling Hippie, who has been one of the biggest activists in outing government officials who ignore the Sunshine laws and other laws that infringe on "we the peoples" rights, is friends with a Ned BoT member who is the head of the Ned task farce.  

This is the same BoT member who last night stated he wanted the task force to have meetings closed to the public--as he "didn't have time to answer to the public".  Yes, I had to heckel that that would be breaking the law.   He told me he didn't ask for public comment.  He also stated he didn't want to keep minutes of his "private Mayors Task Force" meetings.  And then he announced he is putting Cheesecake (who has never lived or had a business in Ned) on "his" task farce that is attempting to thwart the peoples initiative that the BoT has illegally delayed for over a month now. 

All I have to say is if Beth had written an initiative in any town or state and she had experienced the same government refusing to process the initiative,  refusing to time date stamp or give receipt on the language, but instead the town government contacted the A64 attorneys to tell then they supported 95% of the language--but could they (A64 attorneys)  'convince' Rico and Max to withdraw the initiative language all together so they (government) could control the language (totally illegal for the gov to interfere in the processing of a peoples initiative)  --  Beth would be outraged, call them all out and make it all public.   Now I find out Beth is planning on participating with the local gov. in screwing "we the people". 

I guess Cheesecakes personal relationship with a Ned board member and placement on a local government Task Farce that is attempting to thwart a peoples initiative and the will of the local voters on a town she has never lived or had a business, has clouded her principles?

@tutonehcc Yes and what a stroke of brilliance to bring in even more out of state tourist dollars by forcing them to consume all of the up to 5 grams they purchase on premise at the pot shop, and then turning them loose on the roads and into the waiting arms of the Highwaymen in Blue, if they are lucky and don't kill themselves or someone else  driving stoned out of their minds. What a great cash infusion into the economy via the incarceration/"treatment" industrial complex! Christian Turdstone and Kevin Sabet will be proud!
