Alex Landau case: No charges against three Denver cops in his brutal beating

Update below: In February, the Justice Department decided not to charge the officers who beat Alex Landau to a pulp with federal civil rights violations. Then, days later, a cop who pummeled him was reinstated at the conclusion of a separate excessive-force investigation.

Although Landau was frustrated by this turn of events, he hoped for better news from Denver's own inquiry. But no: The Manager of Safety has decided not to prosecute the officers in question.

As we've reported, Landau was a nineteen-year-old Community College of Denver student when he was pulled over by police on January 15, 2009, allegedly for making an illegal left turn.

Marijuana was subsequently found on Landau's passenger, a fellow student named Addison Hunold, prompting the officers -- identified in the lawsuit as Ricky Nixon, Randy Murr and Tiffany Middleton -- to ask if they could search his trunk. Landau is said to have responded by stepping toward the officers and quizzing them about whether or not they had a warrant -- at which point they began punching him in the face. The attack caused Landau to fall, but the beating continued for several minutes, with one officer yelling, "He's going for the gun." (Landau was unarmed.) Once they finally stopped the assault, one officer reportedly put the following question to him: "Where's that warrant now, you fucking nigger?"

A lawsuit over the incident was filed in January 2011 (see it below), and Landau eventually received a $795,000 settlement from the City of Denver for the damage done to him. But officers Nixon, Murr and Middleton still have not been punished for their actions in the incident. Nixon was canned in connection with his role in an alleged assault on four women at the Denver Diner, also in 2009. However, he was later reinstated and remains on the Denver police force, as does Middleton.

And Murr? He was fired for taking part in another high-profile excessive-force case involving Michael DeHerrera -- but the Civil Service Commission recently recommended that Murr be reinstated, complete with back pay.

Now, all three are off the hook in the Landau case. Here's a statement just released by Denver Manager of Safety Alex Martinez's office:

Consistent with the conclusion of the former chief of police, the recommendation of the previous independent monitor, the recommendation of the former acting independent monitor, the recommendation of the current independent monitor, and the conclusion of the current chief of police, as well as the separate decisions of the Denver District Attorney and the United States Department of Justice that there is insufficient evidence to make any criminal accusations against any officers, the Manager of Safety determines there is insufficient evidence to sustain any allegations of inappropriate force, racial slurs or deceptive conduct by Officers Ricky Nixon, Randy Murr and Tiffany Middleton for the incident with Mr. Alexander Landau. Other than reprimands by the Chief of Police for failure to make complete reports, no disciplinary action is taken against any of the involved officers.

IM now in the same situation IM a disabled vet with ptsd. i had a cash back my wife got me somewhat out of it she asked if i wanted her to call a ambulance i told her yes when they showed up i was going back into another flashback she told them what was going on i then ran to the alley next thing i know I'm talking to someone with. a gun telling him to back away you have a gun all IM looking at is your gun i then told him if he backed up i would go to the medics next thing i know two more showed up the big one asked the other one are you ready told me to turn around and when i asked y they jumped on me i tried to get away but all three of them where wrestling me down while being tazed then they got me to the ground one on each arm while the biggest one on top of me hammer punching me in the face while the whole time i was still being tazed when i was dazed they flipped me over i was given a sedative and cuffed.the only time my wife told me they talked to ne is when i was in the er.when i got out my wife called to file a report i got a call on my phone from a officer looking for my wife i told him i was assaulted by the police he stated ya i know i was there when i told him i wanted to file a report he told me no i asked y he then told me i already told your wife.the next day two plan clothes officers came to my house asked to see the the ticket i was given then he told me not to worry about the ticket or the court date that there was going to be a investigation i asked if it was for the report my wife filed with internal affairs he told me no it was a investigation on the incident. the following day my wife is told that the misdemeanor was being bumped up to a felony and all there waiting on is the day to Dinah there end.

I can confirm police are feeling the the heat from the citizens. The only friends cops have are other cops. Around the country police are known as the most brutal criminal gang out there.


As far as DPD goes if you are aggressive with them they beat you to an inch of death. Best thing to do is somehow try and be mellow and low key. Let them make all the mistakes. If you are breaking the law just pay your darn fines and be done with it.

No one follows all traffic laws 24/7. Chances are you will be pulled over so just give them your  DL, insurance, and registration and that is it. You do not need to give them anything else or explain yourself. If they feel like writing you a ticket they will. You then can challenge it in court. The majority of DPD calls are traffic calls.


The best thing good citizens can do is shun cops in business and socially. That is the number one way to get them to change. 

When everything falls apart the cops will not have friends. They are definitely feeling the heat. Take away their pay and license to assault people and they are nothing. They are weak and powerless.  They have zero credibility.

I feel I must comment, and say that Denver & it's surrounding cities & counties, have changed, immensely, since I was a kid...as have police. The story is disturbing to me, personally. I would like to always remain "proud" of the DPD "family" of officers & their superiors. I wonder & ponder the (?'s)

Cops make stuff up to protect themselves. Fact. They could beat everyone to a pulp they encounter and claim they were all reaching for a weapon. They can shoot to kill in that case. It does not give them the right to beat someone who is already under control on the ground. If it does why bother with trials? Just let the cops be judge, jury, and executioner. I for one will be sure to celebrate if these cops get killed. One or both have multiple accusations of excessive force. Trends dont appear out of thin air.

When called back to the stand by the judge for that perjury, she stated -- under oath -- that she was TAUGHT TO LIE as part of her instruction at the police academy.

True story.
