Marijuana: Could medical marijuana grow become major recreational supplier?

A Durango-area medical marijuana grow operation is finally legal, two years after getting a temporary okay from the county to cultivate cannabis. The La Plata County Board of Commissioners unanimously approved a permanent land-use permit last week for Hesperus Mountain Healers (HMH). The operation was originally granted a temporary land-use permit in June 2011; it expired last summer.

The license could position the grow as a supplier for much of Western Colorado. But is that the plan?

Since regulations were loose at first, the county only approved a temporary permit.

"Once the state came out with permanent regulations last summer we put that process in motion," says Naomi Riess, land-use consultant for HMH.

Riess adds that this permit does not change the way the HMH is currently operating. Instead, it merely keeps the existing operation legal. The four-person operation is not open to the public. Instead, it sells strictly to a dispensary in Aspen, which is five hours away.

HMH does not supply any local-area dispensaries, which implies that the business might become a supplier for the southwestern part of the state once recreational sales are allowed at the state level. After all, driving five hours each way to one medical marijuana center in Aspen isn't the most economical way to run a dispensary.

HMH representatives tell us that they haven't considered that option yet. But if they were, this would be perfect timing.

Under Amendment 64 legislation, existing medical facilities will have a nine-month head start at selling recreational marijuana. The Department of Revenue will begin accepting applications for these businesses October 1, with approval to take place no sooner than the first of the year.

New marijuana businesses can begin submitting applications January 1 and may be open for business as early as October 1, 2014.

In the meantime, ganjapreneurs are likely readying themselves for what they hope will be major expansion. With that in mind, HMH may become a growing operation in more ways than one.

During April 1, 2011 until May 1, 2012, Mr. David Krause and Ms. Janet Joyce, the mother of Brenden Joyce, obtained an ownership interest in a warehouse located in Denver, Colorado. This warehouse was owned through a limited liability company named 5105 E. 39th Ave., LLC. Mr.Brenden Joyce, Mr. Hoskins and Mr. Krause conspired to illegally cultivate and illegally cultivated marijuana by improperly and illegally using the medical marijuana optional premise cultivation license for the medical marijuana dispensary Tea Alchemy, LLC. 

Indeed, Mr. Brenden Joyce and Mr. Krause conspired to actively manage the cultivation and distribution of the marijuana. In emails between Mr. Krause and the then owner of Tea Alchemy, LLC, Shasta Fite, the two discuss that the marijuana cultivated by 5105 E. 39thAve., LLC was never sold through Tea Alchemy, LLC. Mr.Joyce, Mr. Krause and Mr. Hoskins knew of the illegal and unlicensed nature of the marijuana cultivated at 5105 E. 39th Ave., LLC’s warehouse and that it would be illegally distributed and sold through Mr. Hoskins’ medical marijuana dispensaries Jane Medicals, LLC and All Care WellnessCenters, LLC. 

Mr. Brenden Joyce and Mr. Howard Zall, the general manager of Jane Medicals, LLC and All Care Wellness Centers, LLC, admitted to distributing over one hundred pounds of the marijuana cultivated and produced at 5105 E. 39th Ave. to Mr. Hoskins’ medical marijuana dispensaries. During an interview given to law enforcement officers, general manager Howard Zall explained that the marijuana illegally cultivated by Brenden Joyce and distributed to Jane Medicals,LLC and All Care Wellness Centers, LLC was sold through Hoskins’ retail stores, Jane Medicals located in Denver, CO and All Care Wellness Centers located in Lakewood. Each person and entity mentioned above stood complicit in one another’s actions to engage in illegal marijuana distribution,the illegal cultivation and the use of telephone calls and email to coordinate the above described illegal activity.

Hey Wax Off -- why is THIS dispensary grow any more "poised" to exploit the purported recreational "green rush" than ANY OTHER of the 100s of existing DISPENSARY Grows ??

I would love to see a micro-grow license, accessible to everyone and inexpensive compared to the commercial sized grows. Similar to the way many start micro-brew businesses in their garage. Making our commercial grows bigger sounds disgusting to me, but so does McDonald's, and they're not going out business anytime soon. Grow your own or find someone with skill to privately do it for you, that's what the true connoisseur will always have to do, no matter how "legal" warehouse weed is.

@DonkeyHotay Good point. Wax-boy says they are "finally legal", however, they just got their local permit. The state won't grant a state permit without a local one, so it is likely they do not have their MMED state permit yet, so not quite "finally legal", are they?

Growing at home shouldn't be any different than having a vegetable garden & would be CRIMINAL to enforce a license !
