Video: Was 30th and Downing light-rail beating a drug deal gone wrong?

Update: Earlier this month, we reported about a light-rail attack caught on camera near 30th and Downing -- the third assault at such a station in the past few months. See our previous coverage below.

The latest: Leopoldo Maes, 23, is the fifth and presumably final person to be arrested in conjunction with the case. However, the working theory about the incident reportedly suggests a drug deal gone wrong, with the victim of the pummeling, seen on video below, declining to cooperate with the investigation.

The assault, which followed crimes at light-rail stations in Lakewood and Arapahoe County in June, wasn't made public for weeks, and neither was the arrest of Daishawn Matthews shortly after it happened. Denver Police Chief Robert White subsequently apologized for the delay -- but information uncovered by CBS4 correspondent Brian Maass suggests a possible reason.

According to the broadcaster, Matthews's bust was followed by cuffings of three juveniles thought to have taken part in the offense. Then, on Friday, Leopoldo Maes, 23, was taken into custody and charged for his alleged role in the attack. Documents received by Westword show that he was jailed on suspicion of robbery and failure to appear on a previous warrant. His mug shot isn't being released at this time because interviews in the case are still ongoing.

Apparently, though, Moscato isn't involved in these conversations: Sources tell CBS4 that he isn't cooperating with the investigation. He's also taken down the Facebook page on which the image seen above was found earlier this month.

Why? Maass is told that the attack doesn't seem to be random, since Moscato appeared to know two of the people who eventually beat him to a pulp, leaving him motionless on the ground. Two police officials who spoke to CBS4 anonymously reportedly believe the six people involved may have been taking part in a drug transaction "that didn't pan out."

Does that mean the five people who beat Moscato will walk? Not necessarily. Denver District Attorney's Office spokesperson Lynn Kimbrough tells Maass that prosecutions can move forward even when victims won't lend a helping hand if there's other evidence of a crime.

Because this country is having "white guilt" as an epidemic. There is a liberal stupidity about, thinking that if we don't treat black thug criminals as criminals, they'll magically transmorph into productive, useful citizens! Checking out the "paused video" frame of this assault, I sent this to a friend of mine, an investigative reporter for a couple major-metro dailies over the years. All I needed to provide as a description was "Yep, I checked." Of course he knew what I meant.

The police on the RTD infuriate me! They are often there during commuter hours, focused on "show me your pass" during the times when the train is filled with working people...they are never there during the late evening when the train is filled with teens and drunken sports fans. I have often overheard large groups of teenagers talking openly about having no ticket, I've seen threats and shoving matches - where are the police? Riding during the weekday doing light duty. If I have to function under armed guard, I'd at least like that armed guard to help me feel safe instead of intimidated.

...I don't entirely disagree with you - because I think people need to take steps to protect themselves. However. The police absolutely do have a duty to protect the citizenry. "To protect and serve" is a long-established law enforcement maxim. It's both how we feel about law enforcement, and the attitude these agencies attempt (admittedly, not always successfully) to instill in their employees. 

To say that the police have no duty to protect citizens flies in the face of what we've established as the basis for our society. The reason this story is shocking is because we have tacitly and directly agreed that we think people should be safe when they leave their homes. We do need more of a police presence at Light Rail stations, because there are persons in those areas who would not be able to protect themselves in the event of an altercation. 

I mean, look at this situation. Five guys attacked one guy. So, not a fair fight to begin with. Lucky for him, no weapons were used, as in the second attack mentioned. Even if he'd gone to catch the train armed, he would have had no way to know if his assailants were also armed. The moment he whips out a gun, there's no going back. That action alone justifies deadly force in the minds of the people around him. And then he dies, instead of being beaten. 

That's not an improvement. 

And please don't tell me that the mere presence of a gun would intimidate these people. I honestly don't think that a group of persons who think savagely beating a man is alright would flinch at the sight of a firearm. We don't know that they had weapons, but the slightest chance that they did would endanger him more if he was armed as well.

Alternately, if there was more of a police presence at Light Rail stations, and it was known that police were going to be around regularly, this type of thing might not happen so often.

Alternately, had this young man been armed it would most likely be HIM walking away unscathed and the attackers on the ground.
