Marijuana: DEA pot raids tied to Florida jewel theft kingpin known as Tony Montana?

marijuana-raid-pile.jpg
Outside a grow yesterday.
Although details are few about Colorado medical marijuana dispensary raids yesterday, we're learning more from warrants that name ten "target subjects."

These individuals allegedly violated one or more of the eight priorities listed in an August memo guiding U.S. Attorneys in dealing with state pot laws that contradict federal policy. One of those is money going toward a criminal enterprise -- and named target Juan Guardarrama is better known among high-dollar jewel thieves as "Tony Montana."

Back in June of 2012, Guardarrama was involved in another raid of sorts down in Miami; it was part of an ongoing, four-year investigation into jewelry heists and the selling of hot merchandise.

Juan.Guardarrama.mug.shot.jpg
Juan Guardarrama's booking photo.
According to the Miami Herald, Guardarrama, 49, attempted to buy about $500k in what he was told was stolen jewelry from undercover cops in June of last year.

During the transaction, Guardarrama also allegedly explained that he was part of a medical marijuana operation in Colorado. He's said to have asked the cops out of the blue if they could help move "some of his Colorado-grown medical marijuana" into the Sunshine State.

That wasn't all. Guardarrama -- who also went by "Scarface" (Tony Montana was the name of the character played by Al Pacino in the 1983 film of the same name) -- then allegedly told the cops about a business partner he wanted "taken out." He reportedly asked the undercover cops if they would do the job for him.

Instead, Guardarrama was arrested on June 7, 2012 and charged with more than a dozen felony counts.

The arresting documents revealed a lot about Guardarrama. Included in them were several accounts of violence and threats to kill other people, such as a man who supposedly owed him $15,000 in gambling debts.

He later allegedly got into smash-and-grabs, targeting traveling diamond dealers -- and police say he was the ringleader of two separate gangs of Colombian and Cuban jewel thieves beginning around 2005.

Continue for more about Juan Guardarrama and his link to yesterday's raid on medical marijuana dispensaries.

*** 2 Marijuana McLawyers down -- more to follow ***

One of the targeted subjects in this raid was Denver attorney David Furtado

State business records identify Furtado as a registered agent for a number of businesses related to medical marijuana and involved in these raids.

So between this bust and the massive criminal indictments in June involving attorney Dallan Dirkmaat and his dirty dispensary pals -- that's 2 (two) Marijuana McLawyers who've been BUSTED for criminal activity involving their clients in less than one year! -- not including attorney Rob Corry's self-destructive quest for habitual criminal infamy.

-- How many more of these corrupt Pot Lawyers will be going to prison along with their criminal clients?

-- How can an honest stoner know that the $$ they paid for "legal advice" isn't going into the bong of just another malpracticing unethical attorney hiding behind a feeble law license and the blind eye of the Colorado Bar Association?

-- How many corrupt lawyer-criminals are fleecing clients in the Colorado marijuana industry?

-- How many Federal Criminal Laws does the Colorado Bar Association Ethics Committee allow its members to deliberately and willfully violate for personal pecuniary gain?

Inquiring minds want to know!

Comparing WW to the Denver Post, I'm enjoying WestWord's coverage of this "event" a lot more.

Eventually there's going to be a lot more coming out of this particular story one way or another, be it either a DEA fraud / harassment prick-waving exercise (masks and all)

OR exposure of professional criminals infiltrating and trying to take over Colorado's budding (sorry) cannabis trade.

Keep up the good work, WW.

Now, if WW would only follow the lead of other papers (e.g. Daily Camera)

and institute some semi-sophisticated / yet affordable IP address-based control / moderation over the trolls and sock puppets that currently ruin the Westword forums and make them almost unreadable.

It can't be THAT hard or expensive, Patricia - they're not rocket scientists over at the Camera, but they've managed to clean up *their* forums quite a bit, without "over-censoring."  Would a simple phone call to the Camera's webmaster kill ya?

Yep. I just got back from a dispensary in Denver and the know it all punk behind the counter 'assured' me that his store didn't get raided because all those 'other guys' are criminals doing something wrong....It's funny to watch the low grade bud dealers turn on each other.,...They won't be singing that tune when they get raided for '??????' (Anything the feds pull out of their ass)....NEWSFLASH: ALL stores in the metro are breaking federal laws! Quit acting like you are special because you got lucky and didn't get raided 'this time'.....

Why would this be bullshit? It makes perfect sense, a raging lunatic criminal turns narc and gets his weed shippers in Colorado in trouble. What's the issue with that? Makes perfect sense. In criminal law, the simple explanation is the truth, no more explanation needed.

Colorado marijuana businesses raided this week by federal agents are being investigated for a possible connection to Colombian drug cartels, sources told The Denver Post on Friday.

Three sources, who have knowledge of the investigation, spoke on condition of anonymity because they are not authorized to speak.

Investigators believe the businesses that were raided are all "one big operation," a source said.

Federal agents swarmed 14 locations, including dispensaries and grow warehouses, in Denver, Commerce City and Boulder County, according to sources. Two homes were targeted.

Investigators believe those targeted in the raids had been actively purchasing area dispensaries and growhouses over a sustained period of time, one of the sources said.

One of the raided dispensaries — VIP Cannabis in Denver — had applied for state licensing but regulators have yet to approve or reject it, said Julie Postlethwait, a spokeswoman for the state Marijuana Enforcement Division, part of the Department of Revenue

----
Classic Marijuana McLawyer scam, play the incompetence and years long processing delays at the ineffective MMED to hide and allow their unqualified criminal clients free reign to operate corrupt dispensaries and commercial grows while the license is "pending" ... then simply refile / change ownership / location before the original application is rejected, thereby literally buying another year or more of time for their unqualified out-of-state / criminal clients to continue to operate while the "new" application languishes in backlogged DoR - MMED system for another year or more.

The story continues to grow ...

"James "Skip" Wollrab, an attorney for one of the targets, said his client did nothing wrong. He said he followed state regulations closely.

"They took $1 million worth of plants from his facility," said Wollrab, who represents Laszlo Bagi, owner of Swiss Medical in Boulder."

Denver marijuana shop broken into, roof lit on fire

Firefighters this morning put out a blaze on the roof of a medical marijuana shop in west Denver in an apparent arson case.

The incident happened about 5 a.m. at the Green Door Wellness Center, 155 Federal Blvd., according to the Denver Fire Department.

Arson investigators at the scene removed melted plastic, likely the remnant of a gas container that was used as an accelerant, said Assistant Chief Mark Ruzycki.

"We put it out real quick," Ruzycki said. "It didn't get inside at all."

Investigators suspect arson as the cause of the fire, which scorched some roof tiles on the back side of the business, which is off an alley running parallel to Federal.

Laszlo Bagi, owner of the business, cleaned up the shop after firefighters found the building to be safe.

Bagi said someone broke a window to get in and disabled the alarm.

Nothing seemed to be missing, Bagi said, noting the marijuana is locked away in a secure, 800-pound safe.

So I can't get into the retail business for 3 years because I am not in the MMJ cartel. Yet the state has let loser Cuban crooks in the business, nice job in setting up a rules and regs to keep the business clean. When the feds shut down ALL pot sales in Colorado you can thank the greedy losers in the MMJ cartel and their pet politicians.

Pot Pimps say -- Business Owners Bad, Pot Advocates Good

Jeff Gard, a Boulder attorney who represents marijuana businesses, said he had seen Wendy Bagi's name on documents but never met her in person and always dealt with her husband. He also said, to his knowledge, they were not involved in advocacy or legislative efforts for the industry.

"My understanding is that they were primarily business owners, not marijuana legal advocates," he said.

Shawn Coleman, a Boulder-based consultant to the industry, said the same thing. Coleman said the fact that none of the names that have come up in the investigation were involved in advocacy efforts was a good thing.

"The people who are open about what they do at council meetings and at the legislative level, they are not getting raided," Coleman said. "They are engaged and are the type of business owners who want to see this program work, and I think that's an important part of the story.

So Jeff Gard isn't a $325 / hour parasite on the industry, and Shawn Coleman works for FREE, like all good Marijuana Advocates, eh?

Federal raids: Boulder pot business owner, wife have history of legal trouble

http://www.dailycamera.com/boulder-county-news/ci_24578615/attorney-raided-boulder-marijuana-grow-we-still-dont

Laszlo Bagi, the owner of one of two Boulder County pot businesses raided by federal agents this week, is also connected to marijuana licensing trouble in the city of Boulder.

According to court records, Bagi was arrested on suspicion of drug use and DUI in 1991 in Boulder and has also been involved in numerous civil suits -- many of them involving marijuana dispensaries -- in several counties in Colorado.

Although her name is not on the search warrant, Bagi's wife, Wendy, is on documents for a grow operation at the facility north of Boulder.

According to Boulder spokeswoman Sarah Huntley, the city revoked two wellness center licenses where Wendy Bagi was purported to be a business owner on May 14, 2012. The primary basis for revocation was unreported changes in ownership, according to Huntley.

The two dispensaries for which Wendy Bagi had her license revoked were Mountainside Wellness Center, 695 South Broadway, and Colorado Care, 250 Iris Ave. Colorado Care is now open under a different licensee.

The only other facility in Boulder County raided was Grateful Meds in Nederland.

Attorney Skip Wollrab said Bagi does not own that business.

Denver attorney David Furtado -- one of the other nine targeted people listed in the search warrant, along with Bagi -- is listed as a registered agent for Grateful Meds in state records.

@.McShyster. Yep, no wonder the DOR failed their audit report. In over 3 years since these businesses applied, there are still some that haven't been granted or denied their licenses. Pathetic. Any other reputable industry would be suing the DOR, but the dispensary owner ostriches just put their heads in the sand and pray that they are not the next targets.

Epic LAWYER FAIL !!

Now that the Criminal IRS and DOJ are investigating Tax Evasion and Money Laundering, this clown's McLawyer has publicly outed his client with a baseline income of $1 MILLION per HARVEST ?!?

So if Lazlo didn't file and declare at LEAST $4 MILLION per year in gross revenue on his State and Federal IRS tax returns, he's got some serious explaining to do.

HipTip: if your lawyer gets high with you, agrees with, aids and abets your hare-brained criminal enterprises, and shares office space with your grow warehouse, then you really don't have an attorney, you've got a co-defendant.

HipTip: According to the Colorado Bar Association's own Ethics Committee -- ANY/EVERY attorney who advises -- much less participates in -- their clients ONGOING CRIMINAL ENTERPRISE -- i.e. Dispensaries that ipso fact violate numerous Federal criminal laws on a daily basis -- is in fact UNETHICAL and subject to disciplinary action, including disbarment.

EVERY ONE of the Marijuana McLawyers is merely one complaint away from losing their license.

@the420rev ... the "real snitches" are the amoral Greedy Big $$ Dispensary pigs themselves, who have ZERO loyalty to anyone but themselves and their unbridled greed, and will turn on and rat out everyone and anyone for a dime, or as soon as they get hauled to jail for a weekend.

Infamous dispensary douchebag and HB1284 clusterfucker Josh Stanley -- a.k.a. Josh Snitchley -- testified in front of the Legislature that he routinely ratted out competing caregiver/vendors who offered to supply his store with bud.

The Dispensary rats have been snitching on each other to the MMED since day one, over trivial crap like the prohibited "free" pot offered in advertisements that appear in Westword's print addition. And they went to town turning their competitors in to the U$ Attorney John Walsh over the 1000 foot school exclusion rule.

The industry itself is replete with gutless punks, big-mouth idiots and snitch-bitch scumbags. Even the Marijuana McLawyers are mostly the dregs of the Colorado Bar association who couldn't make an honest living in law, so they became accomplices, aiders and abettors of their criminal clients' Continuing Criminal Enterprises.

This "industry" deserves itself.

@GuestWho first look at the search warrant above and all this media speculation from the article:

He *was not* registered as an owner as of June 2012, when he was arrested. However, as we noted above, he was *allegedly bragging about being able to move Colorado herb into Florida. He told the undercovers that he had two warehouses in Colorado and even pulled up a live video feed of one of the grows.*

Fast forward to February of this year when Guardarrama pleaded guilty to organizing thefts and reselling millions of dollars of diamonds and other jewels. He was facing up to thirty years in prison, but he received a ten-year probationary sentence, reportedly due in part to his "willingness to cooperate in bringing to justice" to other people involved in the jewel heist.

Could Guardarrama also have squealed on people in the Colorado medical marijuana industry? That's among the many questions that are being asked in the wake of yesterday's raids.

whosdp
whosdp

@Donkey_Hotay_is_GOD In that case, any lawyer who represents a guilty defendant is guilty of unethical behavior.  So attorneys representing illegal aliens would be abetting criminals?

I somehow doubt the Bar's Ethics Committee will be working overtime going after members, solely because of whom they represent.  If there's more to the involvement, say, participation in illegal activities, that's a different story.

Just what is a proffer (also known as a proffer letter) with the federal government? Proffer or "queen for a day" letters are written agreements between federal prosecutors and individuals under criminal investigation which permit these individuals to tell the government about their knowledge of crimes, with the supposed assurance that their words will not be used against them in any later proceedings. (The individuals can either be witnesses, subjects or targets of a federal investigation, although it is subjects and targets who provide most proffers.)...
