Marijuana: More about Laszlo Bagi, one target of federal pot raids

Since last week's raids on several area marijuana businesses, we've been learning more about the individuals named as targets by authorities. Prominent among them is Laszlo Bagi, owner of Swiss Medical Industries in Boulder and grow facilities in Commerce City. Bagi, whose attorney says he's done nothing wrong, is a master plumber and HVAC professional, and while he's had a few brushes with the law over the years, they've mostly been minor. But he's played a part in numerous civil suits over the years and made the news for a dispensary fire, among other things.

Here's the description of Laszlo Bagi and his wife, Wendy, on the website of Bagi Mechanical, whose motto is, "Building Expertise to Building Systems:

The Boulder Daily Camera reports that Bagi's record includes arrests on suspicion of drug use and DUI that date back to 1991, more than two decades ago. More recently, in 2011, he was cited for illegal fireworks and fourth-degree arson.

The following year, Bagi was name-checked in a Westword post related to a fire -- this one at Green Door Wellness, a dispensary at 155 Federal that he owned. There was a break-in at the business and a blaze appeared to have been purposefully set on the center's roof; we've found no reports about arrests in the case.

The Bagis have also taken part in litigation of the sort noted in documents found here.

Wendy Bagi wasn't named in federal warrants related to the raids, but like her husband, she's been involved in numerous MMJ operations over the years. For example, she and Laszlo are both mentioned in a December 2012 document from the Northglenn Medical Marijuana Licensing Authority, before which the Bagis requested an ownership transfer of a business, Green Medicals.

As noted in the complete doc below, Bagi stated that he owned nine medical marijuana businesses and eleven grow facilities in Colorado; he also had numerous people testify as to his character. In contrast, Chuck McGinness, who owned Green Medicals with his wife, Patsin, spoke against the transfer of ownership application. He maintained that Patsin "was forced out of the business by Laszlo and Wendy Bagi before a transfer was approved." In addition, Chuck "presented documentation regarding the debts and purchase of the business, and stated Laszlo Bagi entered into the purchase agreement with the intent to cheat those who were owed money from the business."

In the end, the Northglenn officials rejected the transfer -- but Bagi had plenty of other irons in the MMJ fire when the feds came knocking and put his business at risk. His attorney, James "Skip" Wollrab, told the Camera that $1 million worth of plants were seized by agents, who offered no explanation for their actions. Wollrab feared the losses would bankrupt Bagi, who he said had scrupulously followed all regulations regarding operation of the businesses.

With regard to the sale of Green Medicals, Inc. and the transfer of Green Medicals’ MMJ Business Licenses to Laszlo Bagi and Wendy Bagi, the Purchase Agreement provided by Laszlo Bagi to John Seckman of the MED and currently on file at the MED Offices, is not valid.


The Purchase Agreement is not valid, because as the Honorable Ann B. Frick ruled on January 28, 2014 in the Final Order of case # 12 CV 6868, “.......the change in Ex. A “(The Purchase Agreement)” making the Sellers (McGinnesses) liable, was sneaked in, without notice, at the last moment and was not a negotiated or agreed upon provision.”


To continue, “.......Laslo Bagi’s testimony was vague, impeached by other evidence and not credible.”


And further, “The Court finds that this sneaky and dishonest conduct by the Bagi’s cannot be countenanced and it further casts doubt on their credibility.”

Laszlo And Wendy Bagi had on annex on ripping off chuck and patsin from day one also nick from Colorado care. I personally witnessed this amongs many of his other illegal acts. Glad the Feds put a stop to this guy funded by the illegal investors and no good for the movement at all!

The Colorado Supreme Court’s Standing Committee on the Colorado Rules of Professional Conduct has recommended that the Colorado Supreme Court adopt marijuana related amendments to the Colorado Rules of Professional Conduct. The proposed amendments would insulate a lawyer from discipline by the Colorado Supreme Court for the lawyer’s personal or medical use of marijuana and for the lawyer’s provision of legal services and advice on marijuana-related conduct. The Colorado Bar Association Ethics Committee supports this recommendation.

Seems like it isn't only Donkey_Hotay saying "I told you so" in light of the CO Bar's ethics opinion. See below statement from noted civil rights and constitutional law attorney Andrew Reid, trying again to rally the Marijuana McLawyers in the state to do something smart and collectively on the federal preemption issue, even if it is only to save their own asses, practices, incomes, and futures.

I hate to say I told you so, but this Ethics Opinion fully conforms with my opinion on this issue from several years ago - it's only a matter of time before members of the bar advising MMJ and MJ businesses get hauled before the Colorado Supreme Court's Attorney Regulation Counsel for ethics violations - or get picked up and charge in federal court for aiding and abetting violations of felony drug and tax laws.  The licenses of those now many lawyers that practice in this area are at serious risk and proceed at their own risk.  I've handled quit a few ethics matters for attorneys called before ARC and it is not something to be taken lightly.  Further, as noted in the Ethics Opinion, the same goes for the licenses of all others (doctors, chiropractors, etc.) who provide MMJ services, as well as those who in any manner participate or facilitate MMJ or MJ businesses (including landlords and investors), and the attorneys who advise them in that conduct (with the exception as noted in the Ethics Opinion of the advice that they are breaking federal felony drug and tax laws).

For well over a year, I've also urged a challenge to this as it applies to MMJ businesses under the position that the Schedule 1 listing of MJ within the federal Controlled Substances Act was never meant to include medical uses of marijuana (and that, accordingly, any activities or licenses (including that by lawyers) would not be in violation of federal drug laws).  To date, this issue has not reached the Colorado Supreme (the Court has refused cert on several occasions on this issue) (or the US Supreme Court) and has been very, very, poorly developed and argued to the Colorado Court of Appeals leading to the creation of very bad law in a number of decisions by the Court of Appeals - as well as in a recent federal district court decision before Judge Kane in a missed golden opportunity.  In not one of these instances where federal preemption has come up, has the issue been properly developed, proven, and argued with the appropriate legislative history and acts and expressions of Congress that would demonstrate that the scope of the Schedule 1 listing was and should be limited to recreational use of MJ.  In several other jurisdictions in other states where it has been properly argued, the court has found that the federal CSA does not extend to MMJ.  The US DOJ's and US Attorney's legal opinions on this question are just that "opinions" - they are not law and this issue will remain open until the US Supreme Court rules directly on it (as several courts have already noted, the US Supreme Court's decision in Gonzales v. Raich was not a preemption (Supremacy Clause) decision, but a narrow Commerce Clause decision, and the Court expressly left open the preemption issue for a later date) or MJ is rescheduled out of Schedule 1.  Virtually all Colorado MMJ lawyers have prematurely conceded this legal issue to the US DOJ, which I believe was a very big mistake.   I remain open to working with other attorneys who have MMJ cases where this federal preemption issue comes up to try to develop the necessary record and arguments on appeal that would maximize the chances of success on this issue before another Court of Appeals panel and / or the Colorado Supreme Court - or federal district court or the US Court of Appeals.  Another approach would be for one or more MMJ attorneys to bring a declaratory judgment action, or perhaps an original action before the Colorado Supreme Court, in response to the Ethics Opinion for a determination as to whether MMJ falls within the federal CSA - with a fully and properly developed record and argument on that issue.  Given that it involves a large number of members of the bar of the Court, the Colorado Supreme Court might finally be willing to hear and rule on the preemption issue.  There is really nothing to lose at this point (a contrary ruling would not change the legal status quo) and everything to be gained for those that practice MMJ law.

As to recreational MJ attorneys and those that participate in MJ businesses, the only out I can see is the administrative rescheduling route before the DEA under the CSA or a Congressional one amending the CSA to expressly reschedule MJ or MMJ.  I understand that Colorado and other MMJ states and their federal Congressional representatives are pursuing both routes.  Until then, this Ethics Opinion is a serious threat to all Colorado MJ and MMJ lawyers.

This analysis is a very big reason for MMJ businesses NOT to transition into MJ businesses as there is still an argument that the CSA does not cover MMJ, but there is no defense to the CSA's coverage of recreational MJ.

The Ethics Committee of the Colorado Bar Association (CBA) has formally ruled that it is a violation of ethics rules for attorneys to advise or assist their clients in violation of federal marijuana laws, even if the activities are legal under state law. According to the Colorado Rules of Professional Conduct 1.2(d), "a lawyer shall not counsel a client to engage, or assist a client, in conduct that the lawyer knows is criminal...."

The Opinion states that, despite the fact that "Colorado voters approved a constitutional amendment decriminalizing the possession and use of small amounts of marijuana for recreational use on November 6, 2012", " marijuana continues to be illegal under federal law for all purposes."

The CBA Ethics Committee Formal Opinion states:

"Nevertheless, unless and until there is a change in applicable federal law or in the Colorado Rules of Professional Conduct, a lawyer cannot advise a client regarding the full panoply of conduct permitted by the marijuana amendments to the Colorado Constitution and implementing statutes and regulations. To the extent that advice were to cross from advising or representing a client regarding the consequences of a client’s past or contemplated conduct under federal and state law to counseling the client to engage, or assisting the client, in conduct the lawyer knows is criminal under federal law, the lawyer would violate Rule 1.2(d)."

remains unasked why the MMED allowed this guy to continue to operate when he had So many formal complaints filed against him to the MMED, if the money was being spent on investigations and not fancy no bid overpriced office furniture made by unpaid prisoners most likely the feds wouldnt have had a case here at all. Now if the CBA Ethics Committee / Supreme Court ARC would actually take the initiative to police their own festering nest of greedy corrupt amoral scofflaws and SUSPEND or DISBAR those grossly unethical self-serving lawyer-criminals; and more importantly -- require them to forfeit and return ALL the millions $$$ in legal fees they obtained from unlawfully AIDING and ABETTING the Continuous Criminal Conduct of their Drug Dealing Clients !!

How many Federal Criminal Laws should lawyers be allowed to ignore and willfully violate -- or counsel others to do the same -- simply because they find them to be inconvenient obstacles in their venal quest for personal financial gain?
