Jared Polis to fracking industry: "You can't sue the whole state"

Hydraulic fracturing, or "fracking," is all about opposing forces operating under extreme pressure. Energy companies pump a mixture of water, sand and chemicals into tight shale formations in an effort to extract oil and gas. Cities respond by passing fracking bans designed to extract the energy companies. The fracking industry responds by taking the cities to court. And then Representative Jared Polis pumps some stern admonitions into the ears of the fracking industry, pressing them to stop filing lawsuits.

But at least he's polite about it.

"Please stop suing the communities I represent," begins the letter the congressman just fired off to Tisha Schuller, president of the Colorado Oil and Gas Association, after COGA filed lawsuits against Fort Collins and Lafayette challenging the approval by voters of measures prohibiting fracking in both cities. Although Lafayette's ban is the most controversial, voters in Boulder and Broomfield also approved similar ballot issues last month, imposing a five-year moratorium on new drilling permits despite COGA-backed campaigns that spent close to $900,000 to defeat the measures.

Schuller, the subject of my profile "The Insider" last June, has made no secret of her organization's determination to challenge any outright ban on fracking anywhere in Colorado; COGA is already suing Longmont over the ban it passed last year, as is the state. But Polis, who dubbed himself a fracking "poster boy" a few months ago after a drill rig showed up next door to property he owns in Weld County, isn't one to let all this litigation gush without comment.

While Governor John Hickenlooper has insisted that the state has the primary authority to regulate oil and gas drilling, Polis believes locals have a strong case. "Elections matter," he writes. "Local governments have authority to regulate oil and gas land use activities because oil and gas operations are matters of local concern.... You can't sue, bully, or buy your way to a solution."

COGA spokesman Doug Flanders told the Daily Camera that he found the letter "encouraging," since Polis also stated that he wants the industry to thrive and find solutions. But oh, the pressure.

He usually doesn't support a law unless he can profit from it, via insider trading.

Sure renewable energy has its limitations they are not as limited as the oil and gas industries like to make you think they are. Look at Iceland, France, Germany, England all of these countries and more use more renewable energy than nuclear, gas or oil. Iceland for instance is almost solely powered by geothermal energy to the point where citizens get hot water pumped directly from natural hot springs into their homes. Then take a look at places like China where their air quality is bad you can chew it. They have no EPA or equivalent they have no regulations for gas and oil companies. Factories in China don't even use scrubbers for coal burning this has created a sort of reverse climate change effect. They are pumping so much toxins into the atmosphere that they are creating essentially a shield that is blocking the sun. There is a huge concern among scientists that when China starts using coal scrubbers that the earth will rise as much as 5 degrees in the first year alone. The base of the problems remains the same and always will be. We only have one planet that is capable of sustaining human life and that is Earth. It is our job and duty as the most intelligent life on Earth to take care of our planet so it is around for our future generations to enjoy as well as the less intelligent creatures that share this amazing world with us. The idea that we do not need to worry about what we are doing to our planet is laughable we are destroying this world so a handful of people can make another billion dollars or so. We have to break our addiction to fossil fuels or there will be nothing left for our future generations. I for one would like to leave this planet better off than what was left for me. I am also glad that the mass majority of the people in my generation agree and soon enough we will be the ones in power and like many of the social issues facing our world today will be problems of an old world.

I hope everyone in this thread that is against fracing doesn't use plastics, cosmetics, tires, take airplanes every so often, and a whole host of other uses beyond heating your home or filling up your gas tank, otherwise you risk being massive hypocrites. I support renewables, but they will only get you so far and it's incredibly short sighted if you think they are the answer to everything without their own flaws.

I agree with Jordan, but wanted to point out that home owners that are using renewable energy and selling it back to the power companies are being looked at and the power companies are thinking of charging them 200.00 (whether monthly or yearly I don't remember) for using the infrastructure and not paying for it... so go figure... people are damned if they do and damned if they don't...

This is only slightly complicated by the idea of banning fracking but still using natural gas and methanol and other oil and gas industry products. But that's a false problem, because there are alternatives if people cared enough to switch. Maybe allow cities to impose a ban, but require those cities to have 80% renewal energy (not hydro) within 5 years or something. Dunno?

We can only hope more legislators will take a stand for our communities like Jared Polis has done with his salvos at the O&G Industry.


Until it becomes illegal for public officials to permit, promote and profit from industries that poison our communities, we will be forced to fend for the well-being of such.
