Colorado gun-control laws ruled constitutional despite these arguments against them

U.S. District Judge Marcia Krieger has ruled that Colorado's controversial gun laws don't violate the constitution in a judgement Dave Kopel, who assembled a lawsuit endorsed by assorted businesses and dozens of Colorado sheriffs, has already pledged to appeal.

In May 2013, shortly after the suit was filed, Kopel detailed his arguments for Westword. Here's a look at why he believes the state's ban of all magazines that can hold more than fifteen rounds and a requirement for universal background checks on gun purchases are unconstitutional, as well as Krieger's reasons for deciding otherwise, supplemented by photos, two videos and three original documents, including the just-issued ruling.

Kopel told us that the two laws, known as HB 1224 and HB 1229, "violate the Second Amendment and the Fourteenth Amendment" of the U.S. Constitution, as well as "the Americans with Disabilities Act."

The magazine restrictions are particularly onerous when applied to the disabled, Kopel feels.

"The ADA requires state and local governments to make accommodations for disabled people, particularly in regard to major life activities," he said. "And many disabled people have less ability when they're attacked in their home to retreat to a point of safety or get behind cover from which they can change a magazine. They may have less mobility, or some might have only one arm, for example.

"So it's more difficult for them to change magazines than do other people -- and therefore, even if the magazine ban were constitutional in general, which we argue it is not, the people with relevant disabilities are entitled to reasonable accommodations to larger magazines."

Of course, exceptions for the disabled wouldn't be necessary if both laws are struck down.

What troubles Kopel about the magazine ban? First and foremost, he maintains that while the bill on the subject seems to only prohibit mags that support more than fifteen rounds, it actually "bans almost all magazines."

The reason? A line in the bill nixing magazines that can be readily converted to fit more rounds. Since such magazines are used for semi-automatic handguns and rifles -- and because an estimated 82 percent of handguns and at least one-third of rifles manufactured in the U.S. fit in this category -- he saw the result as "a de facto gun ban even broader than the one that was struck down in D.C. v. Heller," a Supreme Court case that tackled prohibitions against handguns in the District of Columbia.

As Kopel pointed out, "The governor's office and the sponsor of the bill both agree that the magazine ban outlaws all magazines that have removable base plates or floor plates" -- e.g., the kind that can be adapted for more rounds. And while Governor John Hickenlooper is relying on guidance from the office of Colorado Attorney General John Suthers to apply the rule narrowly, such an approach doesn't bring with it any guarantees that the interpretation will stand for all time."

Why not?

"It's not binding on anyone," Kopel said. "You can't force the Denver Police Department to enforce what they would have if the bill had been less aggressively drafted. The words of the statute are what they are, and it can be changed at any time by any future attorney general. If [Democratic state senator] Morgan Carroll is attorney general two years from now, there's no guarantee it will stick around. So our view is, the guidance does not solve the problem of the small magazine ban in practice."

The complaint also attacked the magazine ban on another front.

"The decision in D.C. v. Heller says you can't ban arms that are typically used by law-abiding citizens for lawful purposes -- something that's also called the common-use test," Kopel noted. "For the purposes of this case, then, all we need to do to win is to show that the fifteen-round magazine ban violates the common-use test. And handgun magazines up to twenty are, in fact, in common use by law-abiding citizens for lawful purposes.

"There's also the fact that sheriffs and deputies frequently carry such magazines both as duty guns and personal firearms -- and that's because they're often the best choice for lawful self-defense in defense of yourself and others."

Specifically, section 7061 states: "None of the funds appropriated by this Act may be obligated or expended to implement the Arms Trade Treaty until the Senate approves a resolution of ratification for the Treaty."

Last September, the U.N. adopted the ATT and President Obama directed Secretary of State John Kerry to sign it.  The treaty does not exclude civilian arms from its scope and therefore potentially threatens civilian gun ownership in the United States..

There are indeed some similarities between the right wing of the GOP, and the most reprehensible regime ever inflicted on mankind, Hitler and his Nazi rat henchmen.

1.   The general feeling, whether spoken out right, or kept not-so-subtly-hidden, of being better than others. Nazis, like Republicans, and Republicans, like Nazis, think they’re better. They’re white. They don’t like, not necessarily in this order of dislike, niggers, spics, gooks, zips (Koreans), dinks (Chinese), wops, Jew kikes, Japs, wet-back greasers, camel-jockeys and sand niggers (A-rabs), Frogs, foreigners, immigrants, faggots and butch lesbians, and a host of others. Republicans often talk about (white) Americans as though they’re God’s chosen people, the only people who matter (in the war in Iraq, no mention has ever been made of the number of Iraqis killed because they don’t matter). The Nazis of course called themselves the Master Race.

2.   Religious Xenophobia. God is a Republican. The Republicans tie religious belief to their supposed superiority, and to politics and policy-setting. They know God. You don’t. God favors them, not you, if you disagree with them. The German Nazis had belt buckles that read, “Gott Mitt Uns” (God is with us).

3.   Patriotism as propaganda. Republicans consistently and improperly display the flag, often from car antennas, to demonstrate their patriotic resolve, when the flag was meant to be displayed properly, only in places where decorum would allow dignity. The flag was not meant to be a feckless political prop to back a right wing world viewpoint. For their part, the German Nazis had rallies with thousands of flags.

4.   Love of war. The Republicans used to pride themselves as the party that didn’t start wars, the Democrats did. No more. Today, they never saw a war they didn’t like (they won’t admit it), and view war not as a purely defensive measure as the Founding Fathers intended, but as a useful tool, an instrument of shaping foreign policy. The German Nazis use of war is well known to the world.

5.   Love of radio propaganda. Political talk radio is a largely right-wing creation, to counter what conservatives endlessly contend is the liberally biased mainstream media, and has mushroomed across the country, fed by angry white boys who like to listen to it. It is hosted by a host of American Joseph Goebbels (German minister of propaganda) imitators, who dispense false accusations, right-wing claptrap and mocking, thinly-disguised hate for those who disagree with them. Their most recognizable traits are smugness and the school-yard bully mean spirit.

6.   The cult of the leader (fuehrer). Democrats may praise the tough pluck of little Harry Truman, or the dignified wisdom of FDR, but mythologizing conservatives as some kind of gods brought down from on-high is a right-wing phenomenon that has recently grown in scope. Current deification efforts include among others, Ronald Reagan, John Wayne and the pre-posthumous Rush Limbaugh. The Germans of course had Hitler.

7.   Use of diversions. The Germans used the Reichstag fire of 1933 to suspend civil liberties under emergency decree. George W. Bush used 9-11 to invade Iraq under the guise of false weapons of mass destruction, and to re-make the Middle East. He did illegal wire taps of American citizens to make Americans supposedly safer. Both German and American citizens largely accepted these measures with docility and without debate or protest.

8.   Use of scapegoats. The Germans called people they didn’t like “sub-humans.” The right-wing Republicans call them “bad Americans.”

9.   Contempt for Democracy. Hitler said Democracy was corrupt, soft. Bush said being a dictator would be easier than being president.

10.   The blame game, or denial of bad news. Conservatives, in power for eight years, blame Obama for the country’s impending economic collapse. Hitler said his generals let him down.

Home-Grown, Right-Wing Terrorism: The Hate the GOP Refuses to SeeAs the Las Vegas shootings show, right-wing extremism is real and on the rise. But for Republicans, better to focus on the Muslims.

Remember in 2009, right at the start of the Obama era, when then-Secretary of Department of Homeland Security Janet Napolitano issued a report (PDF) entitled: “Right-wing Extremism: Current Economic and Political Climate Fueling Resurgence in Radicalization and Recruitment”? The report was truly prescient. It alerted us to the rise of right-wing extremism, such as from white supremacist groups, and warned that unchecked, it could lead to violence.

How did Republicans respond? They went ballistic attacking the report. John Boehner was especially upset that Napolitano would use the term “terrorist” to “describe American citizens who disagree with the direction Washington Democrats are taking our nation,” adding, “using such broad-based generalizations about the American people is simply outrageous.”

Well, what have we seen since 2010? An explosion in the number of hate groups and a rash of domestic terrorist acts committed by those very right-wing groups Napolitano warned us about.  Per the Southern Poverty Law Center, since 2010, there have been 32 instances of terrorism by far-right groups—that equals eight attacks per year. (Of course, citing the SPLC won’t move many on the right because they continually tell me on Twitter that the SPLC is biased. They’re correct, the SPLC is biased. Against bigotry.)

The attacks include a plot in 2011 by members of a Georgia militia group to bomb a federal building and release deadly ricin in Atlanta; an attack by a white supremacist on a Sikh temple in Wisconsin that killed six people; another white supremacist planting bombs at a Martin Luther King parade in Seattle; and numerous plots against or actual killings of law enforcement officers.  And this list doesn’t even include the anti-government LAX gunman who killed a TSA officer and wounded another in November 2013, or the attack we saw this past weekend by Jerad and Amanda Miller, who executed two Las Vegas policemen and then tossed the Gadsden flag used by the Tea Party onto the dead officers’ bodies.

So how have Republicans responded to the rise of attacks by right-wing groups? By ignoring it and keeping their focus on foreign terrorists and Muslim-Americans. Perhaps the Republican members of Congress would find it instructive to reread the oath they took upon being sworn into office that provides in part: “I do solemnly swear to defend the United States…against all enemies, foreign and domestic.”
