Marijuana: Recreational pot shop near border miffs Nebraska cops

Categories: Marijuana

A Nebraska highway checkpoint.
There's not much going on in the tiny northeast Colorado town of Sedgwick, which has a full-time population of about 150 people, a game preserve nearby and the South Platte River to play in from time to time -- when the water's up. Most people see the town in their rear-view mirror on their way to or from Nebraska if they ever see it at all. But that could change soon, as Sedgwick now has a major draw: It's the only town within a several-hours' drive to offer legal, recreational marijuana for sale.

But while the shop is fully legal under Colorado state law, Nebraska officials say it is a blatant attempt to profit from residents of their state looking to smuggle herb back home -- and yet another example of how Colorado's pot experiment is failing.

"He's probably going to be the busiest guy in Colorado," Deuel County [Nebraska] Sheriff Adam Hayward said of the nearby pot-shop owner in USA Today last week. "For people coming in from the east, he's basically cornering the market, cutting four hours off a trip because they don't have to go to Denver."

duell.county.sheriff.adam.hayward.jpg
A screen capture showing Sheriff Adam Hayward.
Nebraska cops have been up in arms over Colorado's law since residents passed Amendment 64 in November 2012. But they've become increasingly frustrated since recreational sales of cannabis began for adults 21 and up in Colorado in January and claim that their budgets are being worn thin by busting drivers carrying even the smallest amount of Colorado weed. The police seem to be bringing some of this on themselves, though, by apparently stopping just about anyone with Colorado plates for questionable offenses.

Michael Kollartis, owner of Sedgwick Alternative Relief, insists he's just trying to accommodate rural Coloradans and visitors on their way into the state and says he makes the situation clear to everyone who walks in his shop: If you leave Colorado with weed, odds are high that cops across the border are going to take it from you -- along with some of your freedom.

"Number one: Do not ask me for advice on how to take this out of this state," he says. "And number two: If you do, prepare to give up your firearms, give up your right to vote. I don't want to taint [my business] by coming across as some lowlife drug dealer. That's the complete opposite of what we want to do."

But that's not how some Nebraska officials choose to view it. Earlier this year, some of the state's lawmakers kicked around the idea of suing Colorado as well as demanding money from Colorado for Nebraska law enforcement. And Nebraska state senator Ken Schilz said recently that he might run a bill next year that would increase penalties for marijuana possession in that state.

May I remind Nebraska that Colorado's grocery stores and gas stations do not carry liquor or beer above 3.2%, but theirs do?

So, if NebrASSka residents are bringing back pot, why are the nebrasskiss officers stopping cars with COLORADO plates?  Wait, it's a red state.

They should stop hateing on what colorado does. They want to raise charges from a mistimeanor to a felony for what an 1/8 of pot? Stupid misguided political state policies. Vote in Nebraska people!!!! STOP the idiotic police profiling. Just couse you come from Colorado. I don't see Wyoming profiling for illegal fireworks in to Colorado? Give your voice to make it legal... and piss law enforcement off. Law enforcement are two words combined that don't make sense anyway.

It's a way to NE to profit from something they don't have the guts to pass into law and legalize it.

This one is easy Nebraska. Stop worrying about busting people with small amounts of pot. Better yet, legalize it.

So many people in these comments throw around the "f-word" as though they aren't intelligent enough to communicate in a more effective manner.  The truth is, Nebraska voters decriminalized Marijuana in quantities under one ounce, which is more open minded than Kansas, Wyoming, Oklahoma, New Mexico, Arizona & Utah, which are ALL of the States which border Colorado.  At least Nebraska no longer incarcerates people for small quantities.

Just because the Nebraska law enforcement people are complaining doesn't mean that the NE citizens don't understand the issue.  It must means that the culture of law enforcement and the history of the DEA have brainwashed a lot of people.  The US government has tried to deceive the masses since 1937, when prohibition began... and that's what we (at NORML) are fighting against.

Telling people to go "F" themselves does no good.  It just makes them think that pro-Cannabis people are ignorant and rude and mean-spirited.  Those of us who want to legalize Marijuana nationwide need to articulate our viewpoints in an intelligent and respectful manner.  After all, some of us "pot-smokers" are educated enough to do so.

Reason to worry or more future revenue? It is legal in the entire state here.

Christopher Herrera

How many of their Nebraska residents cross the boarder to buy our legal herb? Are they mad they're not getting those tax revenues and instead them going to Colorado? I wonder how many Colorado residents get busted for cannabis vs Nebraska residents. Gotta love cops favorite tactic of social profiling. They're too inept and stupid to go after real criminals that actually harm society. On the other hand, how about their firework stands they post up just on the other side of our boarder so that we have to go there to obtain fireworks illegal here in Colorado and bring them back here...hypocrisy at its finest. What's more of a social threat, pot smokers raiding the grocery store for munchies or exploding fireworks that cause fires and burn houses down. I say this with all due respect but FUCK Nebraska...and don't even get me started on their meth problems.

Tim Thomsen
Tim Thomsen

Our cops get to deal with their fireworks and they get our pot! Seems fair to me. Of course if Nebraska had any common sense they would just legalize carrying small amounts and then they wouldn't have to worry about it. "I thought I was dead too one time, it turns out I was just in Nebraska"

DeathBreath
DeathBreath

Yes, let's paint that canvas with a wide brush.  So, because folks are taking liberty with buying bud & transporting it across state lines, the whole legalization is a failure?  Since this is a pilot program, so to speak, various adjustments need to be made.  Trust me, cops and the court systems make every bit of their money back with sustained efforts to bust unlucky ones who take unnecessary chances.  They make tons of money through the legal circus.  Oink, oink, oink.

In fact, possession in Nebraska should be a mercy issue.  Who in the hell wouldn't want to get high living in that God-forsaken boring state!  I'm surprised more don't take their lives.

Now they are profiling people because of their licence plate? Looks like a lawsuit to me. I can see lawyers salivating at the idea of sueing the state for illegal searches and seizures. It wouldnt be a big deal if they don't make it a big deal. I find it appalling the police are taking it upon themselves to direct their attention to this when their main focus should be to protect against murders and rapists.I see crime rates rising in those areas because of the lack of police presence, which they will blame on pot.

I agree with the writer below, if most of those funds were put into controlling meth in Nebraska, well - things would probably be better than someone carrying an eighth across the border!

@indica.kush The National Organization for the Retention of Marijuana Laws' claim that THC in blood is correlated with traffic accidents is cited by prohibitionists trying to whip up fear of stoned drivers; I recently answered one of many such articles -- Paul Armentano's faulty policy analysis in 2011 of cannabis' effect on driving  keeps on giving!  Your President has said on national television that medicinal cannabis is too easy to get in California, and he has also called medical cannabis a scam.  Three years ago, your organization celebrated forty years of the non-attainment of its putative goal; with Allen St. Pierre as President, 2051 may roll around without cannabis having been legalized -- and St. Pierre, unless he expires in office, will probably still be President!

@michael.roberts @louis.ruhlin Meth is significantly more common in red states.  It's conservative candy.  When you watch a conservative with their feelings hurt, when they start ranting and raving, notice how ranting conservatives look like they're on meth.
