Davirak Ky gets three years' probation for feeding children pot cookies

Since recreational marijuana was legalized in Colorado, much has been made of children accidentally ingesting edible marijuana -- but what about when people intentionally feed it to kids? Last week Davirak Ky pleaded guilty to distributing a controlled substance and child abuse for feeding two minors cannabis-infused cookies. In exchange, Ky received three years of probation, must undergo drug and alcohol treatment, and has to take a class on the effects of drugs on children -- but he will avoid prison time if he stays out of trouble.

As we reported last fall, Ky was arrested on November 3, 2013 after police responded to a "report of disturbance." The victims' mother told police that Ky, now 41, had brought over cookie dough to make treats for her children, who were thirteen and fifteen at the time.

The boys' mother said her sons were acting "giggly and agitated" after eating the cookies, and the boys were later taken to Denver Health Medical Center, where they both tested positive for marijuana and displayed "high blood pressure and an irregular heart rate, which is not normally caused by marijuana alone." According to the Denver District Attorney's Office, the victims were unaware they were eating THC-infused cookies.

The problem is the person who sold the pot to this idiot is in prison. The person who intentionally fed pot to the kids gets probation, where is the justice in that. Society needs to start taking responsibility for THEIR actions and stop blaming it on the ones who sell the pot. This guy will do it again, but he will do something worse get probation again, do something worse then get probation again, while the nonviolent men who sold the pot to this idiot get prison time.

If the kids were taking them as a prescription medication. With parents consent, The court has no place in this. But... if the guy was just letting kids have his cookies for no other reason than to get high. Yes he should be jaild. You would jail adults for supplying alcohol to a minor. So why not pot?

Seriously?? A man feeding drugs to children... And you feel the courts should "stay out of it"? It's one thing for a consenting adult to consume or smoke a drug-- very much not ok to slip it to kids in a treat. I've seen multiple kids intubated and very very Ill from just accidentally ingesting edibles. This is VERY much the court systems "business".

This must be one of the 10,000+ Arrests for Marijuana that Lyin' Brian Vicente, Mendacious Mason Tvert and Bullshit Betty Aldworth promised A64 would prevent every year.

Yeah, and while we're at it, we should imprison all those mean old parents that give their kids a liquid drug known to be even more addictive and dangerous.  You can find it in a sip of wine at dinner.  We need to monitor those dinner tables of sin with big nanny state cameras.  This is VERY much the court systems "business".

@DonkeyHotay According to the statement of probable cause, Ky was charged with contributing to the delinquency of minors and child abuse, neither of which have anything to do with cannabis per se.

@DonkeyHotay @RobertChase The point, of course, is that no change in the laws against cannabis would have prevented Ky's arrest and that no one promoting Amendment 64 ever so much as suggested that arrests for contributing to the delinquency of children or child abuse would end, so your rant above made exactly no sense.

A64 proponents hypothesized that arrests made due to possession of cannibis would be reduced; arrests made due to the abuse of such a substance - especially when involving minors - is another story. Thus, Robert is also correct about your initial comments being completely unfounded.

Prior to A64, simple possession of up to 2 (two) ounces of rec. marijuana by anyone of any age was NOT an arrestable offense -- it was a petty offense citation with a fine only.


A64 only allows 1 (one) pathetic ounce, and excludes everyone under 21 from any legal access to rec. marijuana.


It was a Gigantic Fucking LIE that A64 would prevent 10,000 arrests for marijuana every year.

@DonkeyHotay @chekje84 You never realize  when you've lost the argument.  Arrests for offenses involving cannabis were reported to have dropped 77% (months ago).  As for the precise number of arrests prevented, while it may not approach 10,000, it is substantial.  As an enemy of Prohibition, I support all measures causing any reduction in arrests for cannabis.
